F,I LW RECORDER WHEN RECORDFD ram. m A cm' aINc, CirY HALL RECUUaS, CALIF. 02376 RESOLUTION NO, 3035 19T5 MAR 30 AM 10 20 A RESOLUTION OF THE CITY OF REDLANDS FINDING THAT A POR- TION OF A STREET IS UNNECESSARY FOR PRESENT OR PROSPECTIVE STREET PURPOSES AND ORDERING THE VACATION OF SAID STREET THE CITY COUNCIL OF THE CITY OF REDLANDS hereby ordains and resolves as follows: SECTION ONE: The City Council of the City of Redlands, having elected to proceed under the provisions of Division 9, Part 3, Chap- ter 2 of the Streets and Highways Code of the State of California, and having held a public hearing as provided therein, hereby finds from all evidence submitted that the street described in this reso- lution is unnecessary for present or prospective purposes and that the public interest and convenience require the closing of said street. SECTION TWO: The City Council hereby orders the vacation of a portion of a street described as follows. Legal Description for Vacating Portions of Fifth Avenue and Farview Avenue That portion of Fifth Avenue and Farview Avenue of Redlands Heights (Craft' s Map) as recorded in Book 11 of Maps, Page 16, records of San Bernardino County, State of California, described as follows : Beginning at the Northwest corner of Lot 1, Redlands Heights (Craft' s Map) said Northwest corner being 25 feet Easterly, measured at right angles from the centerline of 50 foot wide Farview Avenue (Yucaipa Avenue) ; thence Southerly along the West line of said Lot 1, 74, 27 feet to a point on a curve concave Westerly having a radius of 113 . 23 feet, tangent to said curve at last said point bears North 0°11 '44' East; thence Northerly along said curve through a central angle of 35°59 ' 22" , 71. 12 feet; thence North 47°16 ' 12' East, 66 .98 feet to a point on a curve concave Northeasterly having a radius of 544.00 feet, tangent to said curve at last said point bears South 63°44 ' 19" East; thence Easterly along said curve through a central angle of 8° 34 ' 40", 81,44 feet; thence South 0°11 `44" West 7 .65 feet to a point on the North line of said Lot 1; thence Westerly along said North line 103 .00 feet to the Point of Beginning, SECTION THREE° In the proceeding herein adopted by this City Council for the vacation of the street described in Section 2, the City of Redlands reserves and excepts from the vacation the permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove and renew sanitary OK8151 fAGE1008 sewers and storm drains and appurtenant structures, in, upon, over and across any street or part thereof proposed to be vacated and pursuant to any existing franchises or renewals thereof, or other- wise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, railroad lines, and for the distribution or transportation of electric energy, petroleum, and its products, ammonia, water and incidental purposes, including access and right to keep property free from inflammable materials, and wood growth, and to otherwise protect the same from all hazards in, upon, and over the street proposed to be vacated, SECTION FOUR- The City Council hereby determines that the vacation of the street described herein is required by public in- terest, convenience, safety and welfare, ADOPTED, SIGNED AND APPROVED the 20th day of March, 1973 , M r of the City of edlands ATTEST: Cit rk APPROVED FOR FORM City Attorn I, Peggy A.
