MAY 17 A I I 09 i? 1 OFFICIAL PECOROS 5AR 3ER}NARpu o Co CALIF RESOLUTION NO. 2880 CO[ ; i Cu ;a A RESOLUTION OF THE CITY OF REDLANDS FINDING THAT PORTIONS OF AN ALLEY ARE UNNECESSARY FOR PRESENT OR PROSPECTIVE STREET PURPOSES AND ORDERING THE VACATION OF SAID ALLEY THE CITY COUNCIL OF THE CITY OF REDLANDS hereby ordains and re- solves as follows SECTION ONE. The City Council of the City of Redlands , having elected to proceed under the provisions of Division 9, Part 3, Chapter 2 of the Streets and Highways Code of the State of California, and having held a public hearing as provided therein, hereby finds from all evidence submitted that the streets described in this resolution are unnecessary for present or prospective purposes and that the public in- terest and convenience require the closing of said streets . SECTION TWO The City Council hereby orders the vacation of por- tions of streets described as follows Legal Description for Vacating Alley Between Rosette Street and Redlands Boulevard All that portion of 16 foot wide alley in Block 4 of Crescent Avenue Subdivision in the City of Redlands, recorded in Book 5 of Maps, Page 78 thereof, records of San Bernardino County, lying easterly of the east line of 60 foot wide Rosette Street and westerly of the southwest- erly line of Redlands Boulevard, and southerly of Lots 1, 2, 3 and 4 and northerly of Lots 21, 22, 23, 24 and 25 of said Crescent Avenue Sub- division. SECTION THREE- In the proceeding herein adopted by this City Coun- cil for the vacation of the alley described in Section 2, the City of Redlands reserves and excepts from the vacation the permanent easement and right at any time, or from time to time, to construct, maintain, op- erate, replace, remove and renew sanitary sewers and storm drains and appurtenant structures , in, upon, over and across any street or part thereof proposed to be vacated and pursuant to any existing franchises or renewals thereof, or otherwise, to construct, maintain, operate, re- place, remove, renew and enlarge lines of pipe, conduits , cables , wires, poles and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines , railroad lines , and for the distribution or transportation of electric energy, petroleum, and its products , ammonia, water and incidental purposes , in- cluding access and right to keep property free from inflammable materials, and wood growth, and to otherwise protect the same from all hazards in, upon, and over the street proposed to be vacated. The City Council hereby determines that the vaca- tion of the alley described herein is required by public interest, con- venience, safety and welfare ADOPTED, SIGNED AND APPROVED the 4th day of May, 1971.
