A PORTION OF A CERTAIN STREET IS UNNECESSARY FOR PRESENT OR PROSPECTIVE STREET PURPOSES AND ORDERING THE VACATION OF SAID STREET THE CITY COUNCIL OF THE CITY OF REDLANDS hereby ordains and re- solves as follows: SECTION ONE The City Council of the City of Redlands, having elected to proceed under the provisions of Division 9, Part 3, Chap- cr ter 2 of the Streets and Highways Code of the State of California, cr and having held a public hearing as provided therein, hereby finds from all the evidence submitted that the street described in this resolution is unnecessary for present or prospective purposes and that the public interest and convenience requires the closing of said street SECTION TWO- The City Council hereby orders the vacation of a portion of a street described as follows: Legal Description for Vacating portion of Western Avenue South 5 feet of the north 40 feet of the west 1/2, southwest 1/4, northwest 1/4, southwest 1/4, Section 22, Township 1 South, Range 3 West, San Bernardino Base and Meridian in the City of Redlands, lying westerly of the west line of 60 foot wide Lawton Avenue and easterly of the east line of 66 foot wide Texas Street. SECTION THREE: In the proceeding herein adopted by this City Council for vacation of the street described in Section 2, the City of Redlands reserves and excepts from the vacation the permanent ease- ment and right at any time, or from time to time, to construct, main- tain, operate, replace, remove and renew sanitary sewers and storm drains and appurtenant structures in, upon, over and across any street or part thereof proposed to be vacated and pursuant to any existing franchises or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles and other convenient structures, equipment and fixtures for the operation of gas pipe lines, tele- graphic and telephone lines, railroad lines, and for the distribution or transportation of electric energy, petroleum, and its products, ammonia, water and incidental purposes, including access and right to keep property free from inflammable materials, and wood growth, and to otherwise protect the same from all hazards in, upon, and over the street proposed to be vacated SECTION FOUR The City Council hereby determines that the vacation of the street described herein is required by public inter- est, convenience, safety and welfare.
