RESOLUTION NO. 6450
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS
FINDING THAT A PORTION OF LAUREL AVENUE IS UNNECESSARY FOR
PRESENT OR PROSPECTIVE STREET PURPOSES AND ORDERING THE
VACATION OF SAID PORTION
STREET VACATION NO. 131
THE CITY COUNCIL OF THE CITY OF REDLANDS hereby resolves as
follows:
SECTION ONE: The City Council of the City of Redlands, having elected to
proceed under the provisions of Division 9, Part 3, Chapter 2, of the Streets and
Highways Code of the State of California, and having held.a public hearing as provided
therein, hereby finds from all evidence submitted that a portion of Laurel Avenue as
described in Exhibit "A" (attached hereto and made a part hereof) (the "Street") is
unnecessary for present or prospective public use and that the public interest and
convenience require the closing of a portion of said Street.
SECTION TWO: The City Council hereby orders the vacation of a portion of
said Street described in the attached Exhibit "A."
SECTION THREE: For the vacation of portion of said Street described in the
attached Exhibit "A," the City of Redlands reserves and excepts from the vacation the
permanent easement and right at any time, or from time to time, to construct, maintain,
operate, replace, remove and renew water lines, sanitary sewers and storm drains and
appurtenant structures, in, upon, over, and across said street or part thereof proposed to be
vacated and, pursuant to any existing franchises or renewals thereof, or otherwise, to
construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits,
cables, wires, poles, and other convenient structures, equipment, and fixtures for the
operation of gas pipe lines, telegraphic and telephone lines, and for the transportation or
distribution of electric energy, petroleum and its products, ammonia, and water, and for
incidental purposes, including access, and to otherwise protect these works from all
hazards in, upon and over the portion of the street proposed to be vacated.
SECTION FOUR: The City Council hereby acknowledges that there are in-place
public utility facilities in use in the: portion of the street to be vacated and hereby reserves
and excepts from the vacation to be effected by this Resolution an easement for, and the
right to maintain, operate, replace, remove and renew, such existing public utility
facilities. Such easement shall be for the length and width of the portion of the street to
be vacated.
SECTION FIVE. This Resolution shall not be recorded and the vacation of the
street shall not become effective unless and until all conditions of approval, Unposed by
all City Departments for the vacation are complied with to the satisfaction of the City's
Community Development Department.
ADOPTED, SIGNED AND APPROVED this 6th day of December, 2005.
