HomeMy WebLinkAboutOrdinances_2856ORDINANCE NO 2856 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDLANDS AMENDING TITLE 18 OF THE REDLANDS MUNICIPAL CODE BY ADOPTING A REVISED LAND USE ZONING MAP (ZONE CHANGE NO 453) APPROVING A PRE -ZONING DESIGNATION AS EAST VALLEY CORRIDOR COMMERCIAL GENERAL (EV/CG) IN SUPPORT OF A PROPOSED ANNEXATION FOR A 0 764 -ACRE PORTION OF A 1 73 ACRE PARCEL LOCATED AT THE NORTHWEST CORNER OF WEST LUGONIA AVENUE AND TENNESSEE STREET (APN 0167-171-13) WHEREAS, Masterworks, LLC, the authorized representative foi the property owner, has submitted an application foi Pre -Zoning to identify the future zoning designation of the westerly 0 764 -acre of the subject property (currently outside limits) as "Commercial General (EV/CG)" within the East Valley Corridor Specific Plan, in support of the apphcant's related application foi Annexation No 93, and, WHEREAS, on August 8, 2017, the Planning Commission held a public hearing and consideied the staffieport, oral report, the testinony and the written evidence submitted by staff; and, WHEREAS, on August 8, 2017, the Planning Coin russion held a public hearing and considered the application materials, the testimony, and the written evidence submitted by the applicant and by members of the pubhc, and, WHEREAS, the proposed project is not subject to the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15061(b)(3) and there is no possibility that the proposal will result in any environmental effect, and, WHEREAS, following the pubhc hearing on August 8, 2017, the Planning Commission determined that the proposed Pre -Zoning for the westerly 0 764 -acre portion of the subject property would be in conformity with the proposed Genial Plan Amendment as 'Commercial' foi the entire property, and, WHEREAS, on August 8, 2017, the Planning Conurussion recommended to the City Council that the proposed pre -zoning designation and Zone Change be approved, and WHEREAS 011 August 24, 2017, notice of the City Council's pubhc hearing for the proposed pioject was published in the Redlands Daily Facts by the City Clerk, and WHEREAS, following the pubhc hearing on September 5, 2017, the City Council determined that approval of the proposal is in the best interests of the public health, safety and general welfare NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF REDLANDS AS FOLLOWS 1 11ccleik\Ordinances\Nos 2800-2899 in Word12856 - Pre Zoning doe SECTION 1 CALIFORNIA ENVIRONMENTAL QUALITY ACT The proposal is exempt from the California Environmental Quality Act m accordance with Section 15061(b)(3) of the CEQA Guidelines, and the proposal does not require environmental analysis SECTION 2 PROPOSED PRE -ZONING CONSISTENT WITH THE EXISTING GENERAL PLAN LAND USE DESIGNATION The proposed Pre -Zoning designation as "Commercial General (EV/CG)" ofthe East Valley Corridor Specific Plan will be consistent with the General Plan land use designation as Commercial for the subject property SECTION 3 PRE -ZONING DESIGNATION APPROVED. The pre-zomng designation for the westerly 0 764 -acre portion ofthe subject 1 73 acre property, located at the northwest corner of Lugoma Avenue and Tennessee Street (Assessor's Parcel Number 0167-171-13), on the City's Land Use Zoning Map as more particularly shown on the map attached hereto as Exhibit "A" is approved to be designated as East Valley Corridor Specific Plan Commercial General (EV/CG) SECTION 4. EFFECTIVE DATE.
