HomeMy WebLinkAboutOrdinances_2857ORDINANCE NO 2857 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDLANDS AMENDING TITLE 18 OF THE REDLANDS MUNICIPAL CODE BY ADOPTING A REVISED LAND USE ZONING MAP (ZONE CHANGE NO 453) TO CHANGE THE ZONING DESIGNATION TO 'EAST VALLEY CORRIDOR COMMERCIAL GENERAL (EV/CG)' FOR THE EASTERLY 0 966 -ACRE PORTION OF A 1 73 ACRE PARCEL LOCATED AT THE NORTHWEST CORNER OF WEST LUGONIA AVENUE AND TENNESSEE STREET (APN 0167-171-13) WHEREAS, Masterworks, LLC, the authorized representative for the property owner, has submitted an application foi Zone Change No 453 change the zoning designation of the easterly 0 966-acie of the subject property (cunently within the City of Redlands) to East Valley Comxidon Connineicial General (EV/CG), and, WHEREAS, on August 8, 2017, the Planning Conirmssion held a pubhc hearing and considered the staff i eport, oral report, the testimony and the written evidence submitted by staff, and, WHEREAS, on August 8, 2017, the Planning Commission held a public hearing and considered the application materials, the testimony, and the written evidence submitted by the apphcant and by members of the pubhc, and, WHEREAS, the proposed project is not subject to the California Envnonrnental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15061(b)(3) and there is no possibihty that the proposal will result in any environmental effect, and, WHEREAS, following the public hearing on August 8, 2017, the Planning Commission detennmed that the proposed change to the City's Zone Map for the easterly 0 966 -acre of the subject property would be in conformity with the existing General Plan land use designation for the subject property as Conunei anal, and, WHEREAS, following the pubhc hearing on August 8, 2017, the Planning Comnnnssion determined that the proposed change to the City's Zone Map and related change to the East Valley Corridor Specific Plan's Land Use Districts Map would be in conformity with the proposal foi a Specific Plan Amendment for the entire property, and, WHEREAS, on August 8, 2017, the Planning Commission recommended to the City Council that the proposed Zone Change be approved, and WHEREAS on August 24, 2017, notice of the City Council's public hearing foi the proposed project was published in the Redlands Daily Facts by the City Clerk, and WHEREAS, following the public hearing on Septernbei 5, 2017, the City Council determined that approval of the proposal is in the best interests of the public health, safety and general welfare 1 I \ccleik\Ordinances\Nos 2800-2899 in Word12857 - Zone Change 453 doc NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF REDLANDS AS FOLLOWS SECTION 1 CALIFORNIA ENVIRONMENTAL QUALITY ACT The proposal is exempt from the California Environmental Quality Act in accordance with Section 15061(b)(3) ofthe CEQA Guidelines, and the proposal does not require environmental analysis SECTION 2 PROPOSED PRE -ZONING CONSISTENT WITH THE GENERAL PLAN LAND USE DESIGNATION The proposed Zone Change to "Commercial General (EV/CG)" ofthe East Valley Corridor Specific Plan will be consistent with the General Plan land use designation as Commercial for the subject property SECTION 3 ZONE CHANGE APPROVED The Zone Change the easterly 0 966 -acre portion of the subject 1 73 acre property, located at the northwest corner of Lugoma Avenue and Tennessee Street (Assessor's Parcel Number 0167-171-13), on the City's Land Use Zoning Map as more particularly shown on the map attached hereto as Exhibit "A" is approved to be designated East Valley Corridor Specific Plan Commercial General (EV/CG) SECTION 4 EFFECTIVE DATE The Mayor shall sign this ordinance and the City Clerk shall certify to the adoption of this ordinance and shall cause it, or a summary of it, to be published once in the Redlands Daily Facts, a newspaper of general circulation within the City, and thereafter, this ordinance shall take effect m accordance with law dy47- Paul W Foster, Mayor ATTEST Donaldson, City Clerk 2 I 1eclerk\Ordinances\Nos 2800-2899 m Word12857 - Zone Change 453 doc I, Jeanne Donaldson, City Clerk of the City of Redlands, hereby certify that the foregoing Ordinance was duly adopted by the City Council at a regular meeting thereof held on the 19th day of September, 2017 AYES Counci]members Harrison, Gilbreath, Barich, Tejeda, Mayor Foster NOES None ABSENT None ABSTAINED None Donaldson, City Clerk 3 I \Ordinances\Nos 2800-2899 m Word12857 - Zone Change 453 Corrected Exhibit doc Exhibit A THE" H'I !; f91.
