HomeMy WebLinkAbout3459 -RECORDING REQUESTED City of Redlands `� r„� `� ,.?•..: o44 1��� RE��RE�ED [h� WHEN RECORDED MAIL TO : OFFICIAL ?FR.DS City Clerk City of Redlands NO FEE 197E APR 20 AM fl; 28 Post Office Box 280 Redlands, California, 92373 SAN BERNARDIN_; RESOLUTION NO. 3459 CO , CALIF, A RESOLUTION OF THE CITY OF REDLANDS FINDING THAT PORTIONS OF A CERTAIN STREET ARE UNNECESSARY FOR PRESENT OR PROSPECTIVE STREET PURPOSES AND ORDERING THE VACATION OF SAID PORTION THE CITY COUNCIL OF THE CITY OF REDLANDS hereby ordains and resolves as follows : SECTION ONE: The City Council of the City of Redlands, having elected to proceed under the provisions of Division 9, Part 3 , Chap- ter 2, of the Streets and Highways Code of the State of California, and having held a public hearing as provided therein, hereby finds from all evidence submitted that portions of a certain street des- cribed in this resolution are unnecessary for present or prospective street purposes and that the public interest and convenience require the closing of said portions of a certain street. SECTION TWO- The City Council hereby orders the vacation of portions of Sunset Drive formerly Edgemont Drive described as follows : Being a portion of Lot 13 of Sunset Heights as recorded in Book 15 of Maps, Pages 51 and 52, in the office of the Recorder in the County of San Bernardino, State of California, described as follows: N Beginning at the intersection of the Southeasterly line O of Lot 10 of said map of Sunset Heights, with the E� centerline of Sunset Drive (formerly known as Edgemont CD Drive) ; thence N 47°08 '35" W along last said line 254.87 feet to an angle point therein; thence N 72°35 ' 15" W along said centerline of Sunset Drive 154.50 feet; thence N 17°24 '45" E 25.00 feet to the True Point of Beginning, thence S 72°35 ' 15" E 38.21 feet; thence S 59°l0 ' 33 " E 38.21 feet to a point on a tangent curve concave Southwesterly having a radius of 325.00 feet, a radial line through said point bears S 30°49 ' 27" W; thence Northwesterly along said curve through a central angle of 13°24 '42" an arc length of 76.08 feet to the True Point of Beginning. Said Parcel contains 0.001 acres . SECTION THREE: In the proceeding herein adopted by the City Council for the vacation of portions of a certain street described in Section Two, the City of Redlands reserves and excepts from the vacation the permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove and renew sanitary sewers and storm drains and appurtenant structures, in, upon, over and across any street or part thereof proposed to be vacated and pursuant to any existing franchises or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, ji25 Boo rL poles and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, railroad lines, and for the distribution or transportation of elec- tric energy, petroleum and its products, ammonia, water and incidental purposes, including access and right to keep property free from inflammable materials and wood growth, and to otherwise protect the same from all hazards in, upon, and over the portion of the street proposed to be vacated. SECTION FOUR: The City Council hereby determines that the vacation of portions of the street described herein is required by public interest, convenience, safety and welfare.
