CLERK RECORDER SAN BERNARDINO COUNTY, CALIF, RESOLUTION NO. 3338 A RESOLUTION OF THE CITY OF REDLANDS FINDING THAT PORTIONS OF A CERTAIN STREET AND ALLEY ARE UNNECESSARY FOR PRESENT OR PROS- PECTIVE STREET AND ALLEY PURPOSES AND ORDERING THE VACATION OF SAID PORTIONS THE CITY COUNCIL OF THE CITY OF REDLANDS hereby ordains and resolves as follows : SECTION ONE: The City Council of the City of Redlands, having elected to proceed under the provisions of Division 9, Part 3, Chap- ter 2 of the Streets and Highways Code of the State of California, and having held a public hearing as provided therein, hereby finds from all evidence submitted that portions of a certain street and alley described in this resolution are unnecessary for present or prospective purposes and that the public interest and convenience require the closing of said portions of a certain street and alley. SECTION TWO : The City Council hereby orders the vacation of por_t_Lons of San Jacinto Street and alley described as follows : That portion of San Jacinto Street and an alley as shown on Tract No 2090, Cook ' s Third Addition as recorded in Book 30 of Maps, Page 33, in the office of the County Recorder, County of San Ber- nardino, State of California, described as follows : Beginning at the most westerly corner of Lot 9 as shown on said Tract; thence North 32°39 '00" West, 30 00 feet to the northwesterly boundary line of said Tract; thence North 56°19 ' 36" East along last said line 300 00 feet to the northeasterly right-of-way line of said San Jacinto Street; thence South 33°39 '04" East along last said line 116 94 feet to a point on a curve, said point having a radial which bears South 59°Ol '49" East, said curve being concave easterly and having a radius of 70 00 feet; thence southwesterly along said curve through a central angle of 32°18 ' 52 " an arc dis- tance of 39.48 feet to the intersection with the southwesterly right-of-way line of said San Jacinto Street; thence North 33°39 ' 04" West along last said line to the most northerly corner of said Lot 9; thence along the northwesterly line of said Lot 9, 270 feet to the Point of Beginning. SECTION THREE - In the proceeding herein adopted by this City Council for the vacation of portions of a certain street and alley described in Section Two, the City of Redlands reserves and excepts from the vacation, the permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove and renew sanitary sewers and storm drains and appurtenant struc- tures, in, upon, over and across any street or part thereof proposed w_ M9154 ,CE 837 the operation of gas pipe lines, telegraphic and telephone lines, railroad lines, and for the distribution or transportation of elec- tric energy, petroleum, and its products, ammonia, water and incidental purposes, including access and right to keep property free from inflammable materials, and wood growth, and to otherwise protect the same from all hazards in, upon, and over the portions of the street and alley proposed to be vacated. SECTION FOUR: The City Council hereby determines that the vacation of portions of the street and alley described herein is required by public interest, convenience, safety and welfare.
