HomeMy WebLinkAbout3306"ia�� 9070 96 WHEN' RrCCRDIED PJAIL TO CITY GLEM', CITY HALL REDLANDS, CALIF. 92373 620 RESOLUTION NO. 3306 RECORDED Ire O�V�CIAL RECORuS p T Q 1976 WA Vl DEi INJS t, ARDLE CAUF:$ SAN BERtiAIRDIN0 COIJNIf, A RESOLUTION OF THE CITY OF REDLANDS FINDING THAT -PORTIONS OF A CER- TAIN STREET ARE UNNECESSARY FOR PRESENT OR PROSPECTIVE STREET PURPOSES AND ORDERING THE VACATION OF SAID PORTIONS THE CITY COUNCIL OF THE CITY OF REDLANDS hereby ordains and resolves as follows: SECTION ONE: The City Council of the City of Redlands, having elected to proceed under the provisions of Division 9, Part 3, Chapter 2 of the Streets and Highways Code of the State of California, and having held a public hearing as provided therein, hereby finds from all evidence submitted that portions of a certain street described in this resolution are unnecessary for present or prospective purposes and that the public interest and convenience require the closing of said por- tions of a certain street. SECTION TWO: The City Council hereby orders the vacation of por- tions of South Avenue described as follows: Legal Description for Vacation of Portion of South Avenue -- Tract 9368 That portion of South Avenue lying northerly of a line which is parallel with and northerly 35.00 feet, measured at right angles, from the cen- terline of said South Avenue as shown on Map No. 6 of a portion of Redlands Heights, in the City of Redlands, County of San Bernardino, State of California, as shown in Book 7 of Maps, Page 40, records of said County, said portion to be vacated being located between Cajon Street and California Street as shown on said Map. SECTION THREE: in the proceeding herein adopted by this City Council for the vacation of portions of a certain street described in Section Two, the City of Redlands reserves and excepts from the vaca- tion the permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove and renew sanitary sewers and storm drains and appurtenant structures, in, upon, over and across any street or part thereof proposed to be vacated and pursuant to any existing franchises or renewals thereof, or otherwise, to construct, maintain, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles and other convenient structures, equipment and fixtures for the operation of gas pipe lines, telegraphic and telephone lines, railroad lines, and for the distribution or trans- portation of electric energy, petroleum, and its products, ammonia, water and incidental purposes, including access and right to keep prop- erty free from inflammable materials, and wood growth, and to otherwise protect the same from all hazards in, upon, and over the portion of the street proposed to be vacated. boat.9070 F kt 96. SECTION FOUR: The City Council hereby determines that the vaca- tion of portions of the street described herein is required by public interest, convenience, safety and.welfare.
