HomeMy WebLinkAboutContracts & Agreements_16-2007_CCv0001.pdf SECOND AMENDMENT TO AGREEMENT FOR THE PREPARATION OF AN ENVIRONNINETAL IMPACT REPORT AND ASSOCIATED DOCUMENTS FOR THE ENTITLEMENT APPLICATIONS COMMONLY KNOWN AS THE "BULLDOG COMMONS PROJECT" This second amendment(this"Second Amendment")to the Agreement for the preparation of an Environmental Impact Report and associated documents for the entitlement applications commonly known as the"Bulldog Commons Project"dated January 18,2005(the"Agreement"),by and between the City of Redlands, a municipal corporation ("City") and ECORP Consulting, a California Corporation ("Consultant") is made and entered into this 6th day of February, 2007, RECITALS WHEREAS, it is the desire of City and Consultant to amend their existing Agreement to amend the scope of services to be provided by Consultant and to increase Consultant's compensation; NOW, THEREFORE, the Agreement between City and Consultant is hereby amended as follows: i Section 1. Exhibit "A" of the Agreement is hereby amended to include within its scope of services to be performed by Consultant preparation of a revised Administrative Draft EIR and the production an historic architect's report,all as more particularly described in Exhibit"I"attached to this Second Amendment. Section 2. Section 5.1 of the Agreement is hereby amended to read as follows. "For its performance of the Services, Consultant shall be paid on a time and materials basis in accordance with the rates specified in Exhibit "A." Notwithstanding the n foregoig, Consultant's foregoing, compensation for the Services shall not exceed S 53,862." Section 3. All other provisions of the Agreement shall remain in full force and effect. Operations Manager j Lortric Poyzer, e et#111 DJM'Agr�enxrwEawp,A;�0 3 SUPPLEMENTAL SCOPE OF WORK AND COST ESTIMATE BULLDOG COMMONS EIR January 30, 2007 SCOPE OF WOR Task 1— Revised Administrative Draft EIR—A Revised Administrative Draft EIR will be submitted to the City for review and comment prior to recirculation of the EIR. The following is a list of items needed from the applicant and the City: List of Items Needed from Applicant 1. A new site/grading plan showing the new proposal for treatment of the Zanja channel 2. Details on the driveway and pedestrian bridge List of Items Needed from the City 1. Copies of all technical studies prepared for the project ECORP will prepare a historic architect report as follows: Historic Architect Report. The tasks associated with this scope of work will include an intensive-level survey of the Mill Creek Zanja, and the potential impacts to the canal in its proximity to the proposed housing development project. To complete this report, the new site/grading plan and details of the driveway bridge is required. The tasks will be comprised of: * Conduct site inspection/field visit, including photography; + Analyze construction/site plans impacting the historic resource; ♦ Interviews with public and private parties associated with the proposed project; * Review and implement relevant federal, state, and local regulations and standards that apply to the preservation and treatment of historic resources; ♦ Prepare a "Report of Potential Impacts"to the Mill Creek Zanja in the APE of the housing development project. After the listed items are received from the applicant/city, the following will be added to the EIR: ♦ Introduction: - A discussion of the project history and the purpose of the recirculated EIR * Project Description: - A new Proposed Project will be added to the EIR, consisting of no improvements to the Zanja. Additional information will be added to the construction scenario, particularly the proposed change in project site elevation, amount of fill to be brought to the site, and number of trucks and time frame for hauling fill to the site; ♦ Air Quality: A discussion regarding the lack of need for analysis of air toxics will be added. The results of modeling on the additional truck trips for construction fill (already conducted for the comment response) will be added to the EIR section. * Cultural Resources: The results from the historic architect's report will be added. ♦ Hydrology: The results of the quantitative analysis of downstream flooding will be summarized. + Traffic: Additional information on the analysis methodology will be added. The results of the analysis of the construction truck trips and the updated traffic information from Hernandez Kroone and Associates will be added. ♦ Cumulative impacts: Additional information on the analysis methodology will be added. New projects may need to be added to the list of projects. A written request will be sent to the University of Redlands for a list of future projects on their campus. ♦ Alternatives: The original Proposed Project will be added to the alternatives. The berming alternative suggested by the applicant will become a rejected alternative. ♦ Technical appendices: The air quality, biology, cultural resources, historic resources, hydrology, noise, and traffic studies will be compiled into a technical appendix. It has been assumed one copy of each of these documents will be provided to ECORP by the City. Task 2— Notice of Availlabll ity/Completion— ECORP will prepare a new Notice of Availability and will mail it to the mailing list of surrounding property owners provided by the City and post the notice at the San Bernardino County Clerk. We will also provide an electronic copy to the City. It has been assumed that the City will arrange to publish the notice in the newspaper. The Notice of Completion form will be completed and attached to the documents filed at the State Clearinghouse. Task 3— Recirculated Draft EIR— ECORP will produce a total of 20 copies of the Draft EIR: 15 for the State Clearinghouse; 1 for the University of Redlands; 3 for Planning Department files; and 1 for posting at the Smiley Library. Task 4—Administrative Final EIR— ECORP will provide responses to all comments received on the Draft EIR. For the purposes of costing, it has been assumed that there will be substantial comments on the Recirculated Draft EIR from the University of Redlands, and that these comments will include technical review of the studies prepared in support of the EIR. We have assumed that responses to comments on the noise, hydrology, and traffic studies will be provided by the applicant's consultants. Comments on general CEQA procedures, air quality, and cultural resources technical reports will be prepared by ECORP. Errata sheets and a Mitigation Monitoring Program will also be provided in the Administrative Final EIR. Task 5— Final EIR—After review and approval of the Final EIR by the City, ECORP will provide 19 copies of the Final EIR (15 copies for City Council, 1 copy for the University of Redlands, and 3 copies for the Planning Department internal use). Task 6— Notice of Determination/Findings/Statement of Overriding Considerations—A Notice of Determination will be prepared and filed at the San Bernardino County Clerk's office and the State Clearinghouse. Proof of filing will be provided to the City. Task 7— Meetings—A total of 4 meetings have been included in this scope of work: 1 meeting with the Planning Department and City Attorney to discuss the approach to recirculation; 1 meeting after receipt of comments to discuss the approach to comment response; and 2 City Council meetings. The ECORP Project Manager will attend the City Council Meetings. COST ESTIMATE The cost estimate provided below is a time and materials estimate to complete the above scope of work. ECORP has approximately $9,000 left in our original budget. Therefore, we are requesting an amount of$20,305. The Revised Administrative Draft EIR will be submitted 3 weeks from the completion of the Historic Architect Report. The Draft EIR will be mailed to the State Clearinghouse 2 weeks from receipt of comments from the City. The Administrative Final EIR will be provided in 2 weeks from the receipt of comment responses from the applicant's consultants. The Final EIR will be provided 2 weeks from receipt of comments from the City.
