HomeMy WebLinkAboutContracts & Agreements_7-2008_CCv0001.pdf FIRST AMENDMENT TO THE AGREEMENT FOR THE PROVISION OF PROFESSIONAL ENVIRONMENTAL CONSULTING SERVICES This first amendment (this "First Amendment") to the agreement to provide professional environmental consulting services dated August 7,2007(the"Agreement"),by and between the City of Redlands, a municipal corporation ("Cityj :'), and EIP Associates, a division of PBS& ("Consultant"), is made and entered into this 15`h day of January, 2008. RECITALS WHEREAS, it is the desire of City and Consultant to amend their existing Agreement to change Article 2—Compensation-, NOW, THEREFORE, Section 2.1 of the Agreement, entitled Compensation, is hereby amended to read as follows: .2.1 Compensation. As compensation for its performance of the Services,City shall pay to Consultant an amount not to exceed Three Hundred Thirty-Nine Thousand Eight Hundred Thirty- Four Dollars($339.834.00)in accordance with the hourly rates and estimates of expenses contained in Exhibit"A.- Payment to Consultant shall be made monthly, upon City's receipt of an itemized invoice describing the items for which payment is requested. Invoices shall document the status of the Services associated with the fees billed, and are due and payable within thirty (30)days of the date they are received by City." Since the time of the original proposal, it was determined that substantial additional work on the 5`" Screencheck Draft EIR and public review Draft EIR has been required to render the document compliant with CEQA, which work exceeds the amount originally budgeted. In addition, the subeonsultant (KOA Corporation) preparing the traffic impact analysis has subcontracted with PSB&J for $10,112 to perform all remaining work as outlined in their original subcontract with UltraSystems, and has requested an additional $5,000 to prepare additional analyses for the Draft EIR that were not contained in their original scope of work (additional alternative, density analysis). It was also necessary to have a construction health risk assessment (HRA) prepared at a cost of $6,900 to analyze the potential health risks during construction of the pro)ect given its proximity to sensitive receptors (residential uses and the new high school). PBS&J has been requested to distribute the public Draft EIR, a task not contemplated in the original scope of work, for an estimated cost not to exceed $5,000. Therefore, a total change order in the amount of$192,496 is requested, to be presented to the Redlands City Council at your earliest possible convenience. IDS has also agreed verballyto reallocation of the original budget to appropriate tasks. _
