HomeMy WebLinkAboutContracts & Agreements_97-2019May 23, 2019 Via Email Paul W Foster, Mayor City of Redlands 35 Cajon Street Redlands, CA92373 Re Extension of FCC Shot -Clock Deadline on Two (2)AT&T Small Wireless Facility Applications Site One Site Two Dear Mayor Foster AT&T Site ID_ RLOS_RDLN2_002,CityFile CUP No 1126 PROW near 1337 Elizabeth Street FCC Shot Clock Expires May 28, 2019 AT&T Site ID _ RLOS_RDLN2_004, City File CUP No 1128 PROW northeast of 1638 Garden Street FCC Shot Clock Expires May 28, 2019 With respect to the above -referenced applications, federa I law prescribes that a time period of 60 days from the date AT&T filed the application or from a AT&T's response to a timely notice of incomplete application, if any, is considered a reasonable period of time for the City to act on the application, unless the time period to act is extended by mutual agreement between the City and AT&T See 47 C F R § 16003 AT&T submitted these applications on March 29, 2019 The City issued an untimely incomplete notice on April 24 2019 Thus, under the applicable FCC regulation, the applicable deadline for review is May 28, 2019 AT&T understands that the City needs additional review time in order to process the application Without agreeing that this is an appropriate reason for delay, and in an effort to work cooperatively with the City, AT&T offers this extension of the applicable shot clocks for these two applications When countersigned, this letter will confirm agreement between the City and AT&T to toll the applicable time for review to and including June 28, 2019 The parties further agree that no limitations period for any claim related to the timing of the City's processing the application shall commence to run before June 28, 2019 To confirm the City's agreement, please countersign below and return this letter to me Thank you St ?cere � f Dan vozenileR Agreed City of Redlands, California Zdi C By''f3'aul W Foster Mayor
