CONSTRUCTION CONTRACT
This first amendment ("First Amendment") to the public works construction contract
dated June 5, 2018 (the "Agreement") by and between the City of Redlands, a municipal
corporation ("City") and Three Peaks Corp ("Contractor") is made and entered into this 4th
day of June, 2019
RECITALS
WHEREAS, it is the desire of City and Contractor to amend their existing Agreement,
specifically to amend the Scope of Work and Contract Sum of the Agreement; and
WHEREAS, the City Council approved the Agreement with Three Peaks Corp for
work in accordance with the Contract Documents for City's Block 11, within Hillside
Memorial Park,
NOW, THEREFORE, City and Contractor agree as follows
AGREEMENT
Section 1 Article 1 of the Agreement is hereby amended to include the additional
scope of services more particularly described in Exhibit "A," entitled "Scope of Work "
Section 2 Article 2 of the Agreement is hereby amended to increase Contractor's
compensation and shall read as follows
"THE CONTRACT SUM City shall pay Contractor the sum of two hundred thirty six thousand
four hundred fifty one dollars fifty cents ($236,451 50) as consideration for its performance of the
Work in accordance with the terms and conditions set forth in the Contract Documents Pursuant to
Public Contract Code Section 22300, Contractor has the option to deposit securities with an escrow
agent as a substitute for retention of earnings requirement to be withheld by City pursuant to an
escrow agreement as set forth to the Public Contract Code Section 22300 "
IN WITNESS WHEREOF, the parties have executed this First Amendment,
to be effective as of June 4, 2019
