HomeMy WebLinkAboutContracts & Agreements_3-1956m3F,97 m5t.77 COVEAART RUMNING WITH THE LAND I THIS AGREEMEivT, made and entered into this 3 day of 19 by and between -the CITY OF �REDLAlV1JS, California, a municipal corporation, hereinafter referred to as Party of the First Part, and HARROLD BLAIVCHARD BELCHER and DCRIS BERNADI1ZE BELCHLR, husband and wife, hereinafter referred to as Parties of the Second Part. II Parties of the Second Part state that they are the owners as joint tenants of property located at 217-219-221 East State Street in the City of Redlands, said property being described as follows: Lot 3, Block 14, Town Plat of Redlands. III THE CITY OF REDLAN DS, Party of the First Part, hereby consents to the location and construction of an exterior window on the west wall of the building on the herein -described property now owned by Parties of the Second Part, but only on the express con- dition and covenant of Parties of the Second Part that they will close all such windows or other openings on the west wall of their building by masonry construction to conform with all requirements of the Uniform Building Code in the event that at any future time any structure on the adjoining property to the west is caused to be located any distance closer to the west property line of Parties of the Second Part than the now existing set back. IMM- 8 IV PARTIES OF THE SECOD PART hereby enter into a covenant running with the land and agree that, if at a future time any structure on the adjoining property to the west of their property is caused to be located any distance closer to the west property line of the Parties of the 6econd Part than the now -existing set back, then said Parties of the Jecond Part hereby expressly enter into a covenant running with the land and agree to close by masonry construction all such windows or other openings on the west wall of their herein -described property to conform with the Uniform Building Code then in effect in the City of Redlands. W The above covenant in each and every particular is hereby declared to run with the land and shall be construed as a real covenant running with the land and the said PARTIES OF THE bECOAD PART, their heirs, assigns, grantees and successors in interest hereby agree to observe and keep this covenant.
