HomeMy WebLinkAboutContracts & Agreements_4-19574 COVENANT RUNNING WITH THE LAND This agreement, made and entered into this 21st day of February, 1957, by and between the CITY OF REDLANDS, California, a municipal corporation, hereinafter referred to as First Party, and Frank G. Clark, hereinafter referred to as Second Party, 'IITN_21SSETH: I Second party states that he is the owner of the herein- after described real property and that title is held in the name of Frank G. Clark as his sole and separate property, said property being situated in the County of San Bernardino, State of California, located at the Northwest Corner of Brookside Avenue and Citrus Avenues, City of Redlands, described as follows: Lot 1, of Brookside Subdivision, City of 'Redlands, County of San Bernardino, State'of California. II The City of Redlands, First Party hereto, does hereby consent to re -zone said property located at the Northwest Corner of Brookside Avenue and Citrus Avenue, from AP Zone to C-3 Zone. Said re -boning is only on the express condition and covenant of Second Party that said Second Party will (1) cause all buildings and appurtenances to be set back and to be located at Least 15 feet beck of the property lines on Brookside Avenue, (2) close off the existing driveway now located on Brookside Avenue and to cause no driveway nor access to be located on Brookside Avenue, and (3) to cause no driveway nor access to be located on Citrus Avenue within 82 feet of the intersection of the property line of Brookside Avenue and the property line of Citrus Avenue. III Second party covenants and agrees to (1) cause all buildings and appurtenances to be set back and to be located at P*244 least 15 feet back of the property lines on Brookside Avenue, (2) close off the existing driveway now located on Brookside Avenue and to cause no driveway nor access to be located on Brookside Avenue, and (3) to cause no driveway nor access to be located on Citrus Avenue within 82 feet of the intersection of the property line of Brookside Avenue and the property line of Citrus Avenue. IV It is hereby expressly agreed that the covenants contained in Paragraph III hereinabove are covenants running with the land, and that said covenants are binding on the heirs, assigns, grantees, lessees, personal representatives, and successors in interest of Second Party.
