The parties to this agreement are the City of Redlands,
hereinafter called "City" and W. H. Nye, East Highland Avenue,
County of San Bernardino.
The said W. H. Nye agrees as follows:
1. That he is the owner of property on Sand Canyon Road
east of Grafton Avenue upon which is located materials consisting
of decomposed granite suitable for back —filling operations, said
property is described as follows:
Grafton Tract, Lot 6, Block 21, and 'Vest half "C"
street adjacent to said Lot 6 on the East;
Except commencing at a point on the North line of
said Lot 6, 375 feet West of the Northeast corner
thereof; thence South at right angles 20 feet;
thence hest at right angles 40 feet; thence North
at right angles 20 feet to a point on line of said
Lot 6; thence East 40 feet along North line of
said Lot 6 to point of beginning.
2. That he agrees to sell said materials to the City of
Redlands at the rate of fifteen cents (150) per yard, provided that
said materials are satisfactory and acceptable to the City Engineer.
3. That he shall furnish such materials in quantities
and at such times as the City may require, or until he shall give
notice of cessation of this agreement or the supply of said materials
shall he exhausted.
The City agrees as follows:
,L. To pay for all said materials as required for back —
filling at the rate of fifteen cents (150) per yard.
