0TWSETH: That the City and the Contractor, for the
consideration hereinafter named, agree as follows

materials and kill perform all of the work for the following;
Drilling, Casing, Developing, Testing and Completion of a
water production well in accordance with all plans,
specifications and requirements as given in contract
documents.

K TFiB CONTRACT.' SUM: The City will pay the Contractor
in Curren and f'or TRe quantities ac tual? y .constructed and/or
installed in accordance with the prices shown in the laid Form.
40 ROGRESS PAYMENTS: Monthly progress payments to be
made in an.cord�ance wifh 9ection V119 Part I General -Conditions,
of the Specifications.
The _final payment of fifteen per cent (15%) for value of
the work done under this contract, if unencumbered, shall be
made thirty-five (35) clays after the acceptance: of the oom—
pleted contract by the City. The acceptance will be made
only by an action of the City Council of the City in session..
The acceptance by the Contractor of said final payment
shall Constitute a waiver of all claims against the City
arising Lander thiea contract,
5. CONTRACT DOCUMSNTS; The complete contract includes
{ all of the Contract Documents set :forth herein, to wit: The
_notice to Oontractoxs Inviting; Sealed Proposals, Information
for Bidder3, Bid Form, this Agreement, .Did Bond,, Performance
Bond, Special Provisions, and Flans and Specifications and
addenda thereto.
