A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS
FINDING THAT A PORTION OF PARK STREET IS UNNECESSARY FOR
PRESENT OR PROSPECTIVE STREET PURPOSES AND ORDERING THE
SUMMARY VACATION OF A PORTION OF PARK STREET
WHEREAS, Park Street was established by the Fairbanks and Wilson Subdivision in
1887, and
WHEREAS, the Santa Fe Railway established a rail line and depot within the Park Street
right-of-way in 1888, eliminating the use of Park Street as a public street, and
WHEREAS, for more than five years, the remnant of the Park Street right-of-way has not
been used for the purpose it was intended, and
WHEREAS, section 8335 of the Streets and Highways Code of the State of California,
authorizing the City Council to adopt a resolution summarily vacating a street is it has not been
used for the purpose it was dedicated or acquired for five consecutive years immediately
preceding the proposed dedication, and
WHEREAS, Property One, LLC, has submitted an application for the summary vacation
of Park Street, and
WHEREAS, the Redlands Planning Commission, in accordance with Government Code
Section 65402, has deteiiinned during its meeting of May 28, 2019 that the vacation of Park
Street is in conformity with the City's General Plan, and has recommended approval of the
summary vacation application to the City Council of the City of Redlands ("this City Council"),
and
WHEREAS, the determination of the Planning Commission and related material has been
forwarded to this City Council, and
WHEREAS, the proposed street vacation is subject to the California Environmental
Quality Act ("CEQA"), and the City has prepared an Addendum to an application Environmental
Impact Report ul accordance with the State CEQA Guidelines and there is no substantial
evidence of environmental impacts beyond what was analyzed in the Environmental Impact
Report,
NOW, THEREFORE, be it resolved by the City Council of the City of Redlands as
follows
Section 1. The City Council of the City of Redlands, having elected to proceed under the
provisions of Division 9, Part 3, Chapter 4, of the Streets and Highways Code of the State of
California, hereby orders the summary vacation of approximately 495 feet of Park Street, as
more specifically described in Exhibits "A" through "D" attached hereto and made a part hereof,

based upon the following determinations
A For a period of five consecutive years or more, Park Street has been impassable
for vehicular traffic,
B No public money has been expended for maintenance of Park Street during the
period it has been impassible,
C In accordance with Streets and Highways Code section 892, Park Street or parts
thereof are not useful as a non-motorized transportation facility, and
D Park Street is excess and unnecessary right-of-way for street or highway purposes
Section 2 This resolution shall take effect immediately following the recordation of this
resolution by the San Bernardino County Recorder
Section 3 That from and after the date of this resolution is recorded, the portion of Park
Street as referenced herein is vacated and no longer constitutes a public right-of-way ingress and
egress easement
