FIRST AMENDMENT TO THE AGREEMENT WITH HARRIS
ASSOCIATES TO PERFORM MANAGEMENT SERVICES

This first amendment (this "First Amendment") to the agreement to provide consulting
services dated March 7,2006(the"Agreement"),by and between the City of Redlands,a municipal
corporation("City")and Harris and Associates("Consultant")is made and entered into this 6h day
of November, 2007.

WHEREAS,during the pre-construction phase of City's"Boys and Girls Club of Redlands"
construction project (the "Project"), Consultant contracted with the RKA Consulting Group
("RKA")to update the street design the Project and O'Conner CM for cost estimating; and
WHEREAS,soon after the RKA agreement was signed,City's original Architect of Record
Ray Martinez & Associates, failed to fulfill the obligations of his contract with City and was
dismissed; and
WHEREAS, City staff subsequently asked Consultant to obtain the services of an
architectural firm willing to serve as City's Architect of Record and take over the responsibilities of
City's original architect; and
WHREAS, Consultant contracted with JMA Architects to provide architectural consulting
services for City during the construction phase of the Project; and
WHEREAS, due to an inadequacy in the original design,
wired u the footings for the CMU wall
along the property line required upgrading to allow for additional soils retention. To date,Harris has
invoiced $16,414.74 for the re-design of the footings and other architectural services. The re-
designed footings also required additional testing and inspection services provided by Axiom
Testing& Inspection. To date, Harris has invoiced $22,13296 for testing services; and
WHEREAS, Consultant now requests an amendment to the Agreement in the amount of
$39,000 be agreed to by City to compensate Consultant for services performed outside of the
Agreement's original scope; and
WHEREAS,it is the desire of City and Consultant to now amend their existing Agreement to
change Article 5, entitled Payments to Consultant, to compensate Consultant for the additional
services performed;
NOW, THEREFORE, the Agreement between City and Consultant is hereby amended as
follows:
Section i- Article 5 entitled Payments to Consultant is hereby amended to read City shall
pay Consultant additional compensation in the amount of Thirty-Nine Thousand Dollars($39,000)
as compensation for Consultant's performance of the Services, in accordance with the hourly rates
and time estimates set forth in the Scope of Services.

Section 2. All other provisions of the Agreement shall remain in full force and effect.
IN WITNESS WHEREOF,the parties have executed this First Amendment,to be effective
as of November 6 , 2007.
