O, Box 1799 SACRAMENTO 8, CALIFORNIA Amendment of Agreement for State Administration of Local Sales and Use Taxes Enclosed is your copy of the amendment of our agreement for state administration of your local sales and use taxes under the Bradley - Burns Law, to provide that the collections shall be transmitted to the county or city periodically as promptly as feasible. It is suggested that this amendment be kept in your files with the original agreement. This amendment was submitted to the State Department of Finance for approval, which has been given pursuant to Section 13372 of the Government Code by authorizing the State Board of Equalization to enter into such amendments to its contracts under Section 7204 of the Revenue and Taxation Code. The authorization is in the form of a letter of June 19, 1959, applicable to all such amendments, and hence the enclosure does not bear individual endorsement of approval by the Finance Department. As explained earlier, two payments of tax collections will be made during each calendar quarter. In the second month of a quarter, viz., May, August, November, and February, the transmittal, in effect, will be equivalent to 90% of the tax collections for the previous quarter. This will be followed by a "clean-up" payment in the third month of each quarter, viz., June, September, December, and March. Thus, the next payment will be sent in August. Enclosure STATE OARD OF EQ LIZATION By Secretary City of Redlands, California AMENDMENT OF AGREEMENT FOR STATE ADN41NISTRATION OF LOCAL SALES AND USE TAXES Whereas, the City hereinabove designated, hereinafter called the City, and the State Board of Equal- ization, hereinafter called the Board, have heretofore entered into an agreement for state administration of local sales and use taxes as contemplated under Part 1.5 of Division 2, of the Revenue and Taxation Code and are now desirous of amending that agreement in the manner hereinafter set forth, the City and the Board do hereby agree that such agreement shall be amended in the following particulars, to wits Paragraph C of Article II of said Agreement is amended to read- C. Transmittal of money. Except as otherwise provided herein, all local taxes collected under the provisions of the City ordinance shall be transmitted to the City periodically as promptly as feasible. The purpose of the foregoing Amendment is to conform said Agreement to a plan for accelerated transmittal of local sales tax collections as described in a letter of March 12, 1959, addressed to Mr. Richard Carpenter, Executive Director and General Counsel, League of California Cities, by Dixwell L. Pierce, Secretary, State Board of ]Equalization. For the purposes of this Amendment this letter is incorpo- rated in said Agreement by reference as though fully set forth therein. (If the City desires to keep a file copy of the Amendment, an additional copy should be prepared on the form which has been supplied for that purpose.) 3, Attach to each copy of the Amendment sent to the Board, a certified copy of the order, motion or reso- lution of the City Council authorizing the execution of the Amendment. Explanation When an Amendment is submitted in accordance with the foregoing instructions, it will be executed on behalf of the Board and submitted to the State Department of Finance for approval.
