HomeMy WebLinkAboutContracts & Agreements_9-1980_CCv0001.pdf AMENDMENT TO AGREEMENT FOR ENGINEERING SERVICES THIS AGREEMENT, made and entered into. this _ day of by and between the City of Redlands, County of San Bernardino, State of California, hereinafter referred to as "OWNER" and James M. Montgomery, Consulting Engineers, Inc. , hereinafter referred to as the "ENGINEER" .as an amendment to the Agreement between the parties dated March 6, 1979, for engineering services to prepare plans for adjustment of OWNER' s water and sewer pipeline facilities to accommodate the construction of Route 30 between R31. 8 and R33. 3. WITNESSETH WHEREAS, the basis of compensation in said Agreement was determined on an estimate of time to complete the services outlined in said Agreement; and WHEREAS, it was necessary to redesign the water pipeline in Pioneer Avenue from Street Station 169+48 to 173+45 due to a change in street alignment; and WHEREAS, it was necessary to redesign the sewer pipeline in the easement south of Lugonia Avenue from Pipeline Station 6+30 to 10+15 to reduce construction costs by importing select backfill material for additional pipeline cover for improved pipeline integrity; and WHEREAS, it was necessary to provide for the continuing utilization of the existing sewer pipeline in Lugonia Avenue with temporary pipeline facilities which was not anticipated in said Agreement; and WHEREAS, it was necessary to do additional field survey work to provide for cultural details not anticipated in said Agreement; and C, WHEREAS, the actual salaries listed in Schedule "A" of said Agreement were effective only to September 1 , 1979 and revised actual salaries are appropriate for the time thereafter; and WHEREAS, it is the desire of both parties to amend said Agreement to provide for the above engineering services and salary increases. NOW THEREFORE, in consideration of these premises and of the mutual benefit -,,which will accrue to the parties hereto in fulfilling the terms of said Agreement, it is mutually understood and agreed to as follows: A Section II(B) of said Agreement should be: Schedule "A" 1. AGENDA ITEM for Council Meeting of April 1 , 1980 (Date) SUBJECT: Amendment to Agreement for Engineering Services Utility Relocations for Tennessee Freeway SUBMITTED BY: Name John A. Donnelly Dept. Public Works EXPLANATION: The City of Redlands entered into an agreement dated March 6 , 1979 with J. M. Montgomery, Consulting Engineers for the purpose of having the firm prepare plans and specifications for the utility relocation work resulting from the construction of the Tennessee Freeway. An amendment is required because of changes in engineering services resulting from State highway requirements not anticipated and because of salary increases of the firm' s staff. It was anticipated that the project was to be completed by September 1 , 1979. The State is to reimburse the City for consulting engineering services required to' accomplish the relocation work. It is recommended that Council authorize the Mayor and City Clerk to ecute the Amendment to the Agreement . (Supporting material to be attached)
