This agreement was approved by the City Council of Redlands at their meeting on August 6, 195'7, and signed by the Mayor of Redlands. V. iallE District Engineer By District Design Engineer 1 VIII-SBdm26-Rld 2 FREEWAY AGREEMENT 3 4 THIS AGREEMENT made and entered into, in duplicate, this 5 day of A LGUS _r , 19579 by and between the STATE 6 OF CALIFORNIA, acting by and through the Department of Public 7 Works, Division of Highways, hereinafter for convenience referred 8 to as "the State," and the CITY OF REDLANDS, hereinafter for con- 9 venience referred to as "the City," 10 WITNESSETH: 11 WHEREAS, the California Highway Commission has adopted a 12 resolution on July 24, 1957,, declaring that certain section of 13 State Highway Route 26 in the County of San Bernardino between 14 Hunts Lane and the East City Limit of Redlands to be a freeway, 15 and 16 WHEREAS., a plan map for such freeway has heretofore been 17 prepared showing the proposed plan of the State as it affects 18 the streets of the City, including provisions ,for closing city 19 streets, for construction and relocation of city streets., for 20 carrying city streets over or under or to a connection with such 21 freeway, and for construction of frontage roads. 22 NOW THEREFORE, it is agreed: 23 1. The City agrees and consents to the closing of city 24 streets, relocation of city streets,, and other construction 25 affecting city streets, all as shown on said plan map attached 26 hereto marked Exhibit "A"9 between the West City Limit 27 (Tennessee Street) and the East City Limit (Wabash Avenue) 28 and made a part hereof by this reference. 29 2. The State in the construction of said freeway will, 30 at the State's expense, make such changes affecting city streets 31 in accordance with the said plan attached hereto or as the same �1� 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 may hereafter be modified by subsequent agreement between the parties hereto. 3. The State agrees to acquire all real property and interests in real property required for construction affecting city streets and the City authorizes the State to acquire in its behalf all such real property or interests in real property. 4. The City will accept control and maintenance over the city streets to be constructed and relocated, and will accept control and maintenance of the frontage roads on notice to the City from the State that the work herein provided for on such highways and roads has been completed, except as to any portion thereof which is adopted by the State as a part of the freeway proper, 5e The grade separations shown on said plan map, attached hereto marked Exhibit "A" will be either undercrossings or overcrossings as detailed engineering studies may determine will best fit the locality. 6. It is understood that construction of this freeway may be by stages. 7. D'U-RKE Director of Public Works By AUG 2 3 1957 THE CITY OF REDLAND S a rlunininal nnrnn?-P+A nn RESOLUTION N0. 882 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLAND,S CONCERNING FREE1AY AGREE2MNT RELATING TO STATE HIGHVAY ROUTE 26 WHEREAS, the freeway agreement with the State of California for freeway development of US Highway 99 between the ' b_st City Limit at Tennessee Street and the East City Limit at Wabash Avenue has been fully considered, and, it appearing that the following action is proper and is taken in the best public interest; now, therefore BE IT HERESY RESOLVED by the City Council of the City of Redlands that it approves of that certain Freeway Agreement dated August 6, 1957 with the State of California, acting by and through the Department of Public Works, Division of Highways, relating to that certain section of State Highway Route 26 in the City of Redlands between the List City Limit at Tennessee Street and the East City Unit at Wabash Avenue, subject to specific recommendations made by the Planning Commission of the City of Redlands on the 6th day of August, 1957. BE IT HEREBY FURTHER RESOLVED that the Mayor of the City of Redlands is hereby authorized to execute said freeway agreement on behalf of the City of Redlands. VIII-SBd®26-R1d SUPPLEMENTAL FREEWAY AGREEMENT THIS AGREEMENT made and entered into# in duplicate# this l,t� day of Set)tember - _ --- g 1959s, by and between the STATE OF CALIFORNIA., acting by and through the Department of Public Works, Division of Highways, hereinafter for convenience referred tb as 'State," and the CITY OF REDLANDS, hereinafter for convenience re- ferred to as ''City,"` WITNESSETH: WHEREAS,, State and City have heretofore entered into a Freeway Agreement dated August 69 1957, relating to that certain portion of State Highway Route 26 in the City of Redlands, be- tween west city limit (Tennessee Street)# and east city limit (Wabash Street)# and WHEREAS,, the plan of constructions as shown on Exhibit "A" attached to said agreement, has been altered in certain respects since the date of execution of said agreement; and WHEREAS9 a new plan map has been prepared showing the altered plan of construction, NOW THEREFORE9 it is agreed° 1, That the plan map attached hereto, marked Revised Exhibit "A"19 shall be substituted for Exhibit "A" attached to the Freeway Agreement dated August 6# 1957, and 'become a part of said agree- ment for all purposes o 2. Later in the meeting a recommendation was returned that the bid of Robert Simon be bid submitted, be accepted. On motion of Councilman Ma the ti ezzualified seconded by Councilman Burroughs, this recommendation of the Department of Public Works was unanimously approved by the City Council, At the Council meeting of May 3 bids had been submitted on the relocation of sewer facilities in connection with freeway construction and had been referred to the Department of Public Works for study and r±corn- mendation. At this time a recommendation was returned that the bid of the DeLeon Construction Company in the total amount of t the bid covering Projects l and 2, be accepted, 13-70 On motion of Councilman ithison, seconded by Councilman Martinez, this recommendation of the Department of Public Works was unanimously approved by the City Council, Public hearing had been scheduled for this time and place on Resolution No. 2027, initiating annexation proceedings on Annexation District No, 8. Manager Workman at this time informed the Council that the Petitioner, Mr. J. N. Schmidt, President, Inland Research, Incorporated, CITY MANAGER ' Resolution No 2035, a resolution of the City of Redlmdx aauthor,9 the filing Of an application from Resolution No. 2035 the State Division of Highways x11 the Public Utilities Commission in connection with the alteration and/or widening of First and Sitth Streets, presented by the City Xaamger and adopted on motion of Councilman Wilson, seconded by Coumilman Burr nghp. The City will acquire Public Utility Commission approval of the new First Street crossings of the Atchison, Topeka, and Santa Fe Railway and Southern Pacific Company railroad. rights of way prior to August 1, 1960. 4. That except for the substitution of the second revised plan map and except for the provisions of clauses 2 and 3 above, said Freeway Agreement dated August 6, 1957, and. Supplemental Freeway Agreement dated. September 1, 19599 shall remain in full force and effect, unmodified by any provision of this agreement. NOW THEREFORE, it is agreed: 1.
