THIS AGREMMENT made and entered into as of this 20th
day of June , 1961, by and between the STATE OF
CALIFORNIA., DEPARTMENT OF PUBLIC -WORKS, DIVISION OF HIGIM.AYS,
hereinafter referred to as HIGHWAYS, and CITY OF RMLANDS,
hereinafter referred to as the CITY.
1. HIGHWAYS owns or has possession under an Order of
Immediate Possession of the property situated in the County of
San Bernardino, State of California, shown on the map attached
hereto as Exhibit A.
All of this property, as shoTm on Exhibit A, overlies
the Santa Ana River Basin or is riparian to a surface stream
within the watershed of the Santa Ana River.
2. As the overlying owner of said land, HIGHWAYS has
the legal right to take such amounts of water as is reasonably
needed for beneficial purposes on its property.
3. HIGHWAYS hereby appoints the CITY as its agent for
the following purposes:
a. To produce from the underlying basin, water in
amounts reasonably needed for beneficial purposes
on HIGHWAYS land, as herein described.
b. To supply and deliver this water to HIGHWAYS
land for exclusive use thereon, particularly for
the purpose of constructing, maintaining, and
beautifying the Redlands Freeway.
4. HIGHWAYS does not hereby convey to CITY any water
right, including its overlying right, but intends that such
water and water rights in the San Bernardino Basin should

remain annexed to HIGHWAYS land, and that the CITY shall have
only the right to take and distribute the same as agent for
the HIGHWAYS, its assigns and successors in interest,
STATE OF CALIFORNIA.
