HomeMy WebLinkAboutContracts & Agreements_1A-1963A G R E E M E N T THIS AGREEMENT entered into on January 15., 1963, between Security Homes, contractor, and David Duthie and Anne B. Duthie, owners, concerning building construction on the property located at 936 Carob Street, City of Redlands, County of San Bernardino, State of California., described as follows: Lot 37, Crescent Heights Subdivision, Tract No4 19820 in the City of Redlands, as per plat recorded in Book 28 of Maps, pages 73, records of said County. IT IS �,G-REED s 1. That T erea.s, the driveway leading; from Carob Street to the carport has too steep a grade to conform to the City Building Code, and it is impractical to replace the driveway, and 'O.iereas, the present grade of the driveway is too steep to allow adequate use thereof by the owners, and Whereas, each of the parties hereto desire to effect the con- struction of a driveway which will be useable by the owners, the Taa.rties hereto do hereby make this 1'�.gree ent® 2. It is agreed that the contractor shall increase the width of the driveway from the present width of 16 feet, to 23 feet, bring- ing the street entrance up to the ;i-�-easterly lot linen The increase in the width of the driveway shall taper from 7 feet at the street, to approximately 32 feet at the halfway point, to 0 at the carport. 3, It is farther agreed that the owners do hereby waive the requirement that the grade conforan to the Building Code, and they do hereby relieve the City of Redlands of all responsibility in connection with this waiver. -1- 4� It is further agreed that the contractor will make said changes in a workmanlike manner and in such way that the driveway is useable by the owners without causing damage to their vehicles while entering upon and using said driveway.
