Applicant and all successors in interest agree to pay all costs of suit and reasonable attorneys fees for such action. City hereby covenants as follows: 1 That the City Council has found that the pro- visions of this agreement do not adversely affect the health, safety and welfare of the public, and has been so advised in a recommendation duly filed by the Advisory Committee on the 2nd day of Col July , 196 3 . 00 2. That the requirements as described in Lot Line Adjustment No. 33 are hereby waived, provided that Applicant agrees in writing to participate in any street improvement program which includes or affects Applicant ' s real property, as described in para- graph 2 of Applicant ' s covenants herein.
