THIS DECLARATION AND AGREEMENT made this day of
June, 1964, by and between JAMES ARMSTRONG, hereinafter referred to as
"owner" and the City of Redlands, a political subdivision of the State of
California, hereinafter referred to as "City".
RECITALS
1. Owner presently owns the following described property:
Lot 6 in Block d of Lugonia Heights in the City of
Redlands, County of San Bernardino, State of
California, as per map recorded in Book 8 Page
12 of Maps, Records of San Bernardino County.
Said property is commonly known as 832 High
Avenue, Redlands, California.
2. Owner is desirous of inducing City to make certain inspections
and grant certain approvals.
NOW THEREFORE, Owner declares that the property above
described is held and shall be conveyed subject to the restrictions, conditions,
covenants, charges and agreements set forth in this declaration, as follows:
I
Owner shall not sell, transfer, assign, or conveythe above
described parcel except as a single and whole parcel so long as said parcel
is used for multiple -residence purposes.
II
The provisions contained in this declaration shall bind, and inure
to the benefit of, and be enforceable by, all parties her eto, their heirs,
legatees, devisees, administrators, executors, successors and assigns.
IN WITNESS WHEREOF, the undersigned has executed this
agreement and declaration on the day and year first above mentioned.
