HomeMy WebLinkAboutContracts & Agreements_5-1965C AGREEMENT This Agreement by and between the City of Redlands, a municipal corporation of the State of California, herein- after called "City", and Terracina Park, is dated this day of Q, 1965. RECITALS 1. Terracina Park has signed an Agreement with City to participate with the City and other parties to con- struct a sewer line extending from a point of beginning at the intersection of Olive Avenue and Lakeside Street along Olive Avenue in a westerly direction to Terracina Boulevard and thence along Terracina Boulevard in a southerly direction to Fern Avenue, hereinafter called "sewer line". Terracina Park agrees that its share of the cost shall not exceed $11,000.00 in the agreement, dated January 11, 1965, which is attached hereto as Exhibit A. 2. Terracina Park has applied to City for issuance of building permits for the construction of four buildings at 355 Terracina Boulevard, Redlands, California. City, at the time a building permit is issued, requires a "sewer con- struction charge" as specified in Ordinance No. 1270. Terracina Park's "sewer construction charges" for the four buildings, (Buildings A, B, C, and the Convalescent Hospital) is approximately $2,690.00. 3. For a valuable consideration, the parties agree as follows: a. The City will issue building permits to Terracina Park for the four buildings to be constructed at this time at 355 Terracina Boulevard, Redlands, California. b. The City defers payment of "sewer construction charge" by Terracina Park, until the sewer line is completed. c. Terracina Park agrees to pay the "sewer construction charge" of approximately $2,690.00 and its share of the cost of installation of the sewer line upon its completion and demand for such payment by the City. 4. This agreement shall accrue to the benefit of and be binding upon all assigns, lessees, mortgagees, trustees, heirs, executors and other successors in interest to the parties hereto. RECITALS 1. Each of the parties will be benefitted by the construction and installation within the City of Redlands of a sewer line which shall be 10 inches in diameter, and shall, ex -tend generally from a point of beginning at the intersection of Olive Avenue -and Lakeside Street along Olive Avenue in a westerly direction to Terracina Boulevard and thence along Terracina Boulevard in'a southerly direction to Fern Avenue. 2. T & 0 Properties owns the real property located at the southeast corner of Olive Avenue and Terracina Boulevard, and will be benefitted by the construction of the sewer line adjacent to such property. 3. Terracina Park owns real property located at the. northeast corner of Fern and Terracina Boulevard, and will be benefitted by the construction of the sewer line adjacent to such property. 4. Redlands Community Hospital owns real property located at the northwest corner of Fern and Terracina Boulevard, and will be benefitted by the construction of the sewer line adjacent to such property. S. The City of Redlands will be benefitted by the addition of the line to the municipal sewerage system. For a valuable consideration and the mutual_ covenants set forth herein, the parties agree as follows: I. To participate in the payment of construction costs of installation of the sewer line in the fo11o43i.ng proportions: (1) The City of Redlands shall pay the difference in the cost of materials required for the 10-inch line de- scribed herein and an 8-inch lane_ (2) T & © Properties shall pay the surd of $8,000.00. (3).. Refunds of amoinits advanced by the parties frol'a connection charges collectod as provided in Chapter 83 of the Redlands Ordinance Code shall be apportioned araong the parties hereto in the sarae ratio as each of t1heir contributions bears to the total sun advanced for the sewer line. 2� 'The specific location of the se-v:er line shall be determined by the Public -Works Director of the City of Redlands.
