by and
between the CITY OF REDLANDS,
,California, a municipal corporation, hereinafter

referred to as Party of the First Part, and MAURICE CLAPP, hereinafter
referred
to as Party of the Second Part.

Party of the Second Part states that he is the owner of property located (�
at 215 West Redlands Blvd., in the City of Redlands, said property being des-
cribed as follows:
Lot 9, Block 3, Town Plat of Redlands.

THE CITY OF REDLANDS, Party of the First Part, hereby consents to the present
location of an exterior window on the west wall of the building on the hereinafter
described property now owned by Party of the Second Part, but only on the express
condition and covenant of Party of the Second Part that he will close all such
,windows or other openings on the west wall of his building by construction to con-
form with all requirements of the Uniform Building Code in the event that at any
future time any structure on the adjoining property to the west is caused to be
located any distance closer to the west property line of Party of the Second Part
than the now existing set back.
IV
PARTY OF THE SECOND PART hereby enters into a covenant running with the
land and agrees that, if at a future time any structure on the adjoining property

to the west of his property is caused to be located any distance closer to the
west property line of the Party of the Second Part than the now -existing set
bads then said Party of the Second Part hereby expressly enters into a covenant
running with the land and agrees to close by construction all such windows or
other openings on the west wall of his herein -described property to conform with
the Uniform Building Code then in effect in the City of Redlands.

The above covenant in each and every particular is hereby declared to run
with the land and shall be construed as a real covenant running with the land and
the said Party of the SECOND PART, his heirs, assigns, grantees, and successors in
interest hereby agree to observe and keep this covenant.
