HomeMy WebLinkAboutContracts & Agreements_16-1965A G R E E M E N T August 24, 1964 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 THIS AGREEMENT, by and between such counties of the follow- ing: Los Angeles, Orange, San Bernardino, Riverside and Ventura,. as shall execute this agreement in accordance with its terms, the Southern California Rapid Transit District, and the California Highway Transportation Agency, acting through its Department of Public Works, and such cities in the area defined in Part I below as shall ratify this agreement in accordance with its terms. WITNESSETH: WHEREAS, the Congress has added Section 134 to Chapter 1 of Title 23, United States Code, declaring it to be in the national interest to encourage and promote the development of transportation systems embracing various modes of transport, J: - in a manner that will serve the states and local communities efficiently and effectively, and which are based on a continuing ,comprehensive transportation planning process carried on co- operatively by states and local communities. WHEREAS, comprehensive planning for urban development is Ineeded on a continuing basis and is consistent with national (policy as expressed in Section 701 of the Housing Act of 1954, !as amended, and WHEREAS, the comprehensive character of the planning process requires inventories and analyses of the following basic elements:] 1 Economic factors affecting development; 2 Population; 3 Land Use; 4 Transportation facilities; 5 Travel patterns; 6 Terminal facilities; 7 Traffic control features; 8 Zoning ordinances, subdivision regulations, building codes, etc; (9 Financial resources; (10 Social and community -value factors, such as preservation of open space, parks and recrea- tional facilities; preservation of historical sites and buildings; environmental amenities; and aesthetics; and WHEREAS, Federal -aid highway funds may be available for 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 financing transportation elements of the planning studies, and WHEREAS, Federal Housing and Home Finance Agency and local agency matching funds or services may be available for financing economic, demographic, and land use elements of the planning studies. NOW THEREFORE, the signatory and the ratifying parties do agree as follows: I. The intent of this agreement is to provide organiza- tional and working arrangements for a continuing, coordinated, comprehensive transportation planning process in the Los Angeles Regional Transportation Study (LARTS) area delineated on the attached map and made a part hereof. Ii. A. As a forum for broad policy considerations and recommendations .relating thereto there is herewith established an AREA COORDINATING COMMITTEE. B. Initial membership of this committee shall consist of: (1) A member of the Board of Supervisors or designate of each county executing this agreement, (2) A member of the City Council or designate of each City ratifying this agreement, (3) Administrator or designate of the State Highway Transportation Agency, (4) A designate of the Southern California Rapid Transit District. C. A meeting of the Area Coordinating Committee shall be held upon written notification by the Administrator of the Highway Transportation Agency -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29' 30 31 acting for the signatory parties jointly. This meeting shall take place within 60 days of the date of the execution of this agreement by the Highway Transportation Agency. At this meeting, the Area Coordinating Committee shall: (1) determine rules for the conduct of its business, (2) determine the means of, augmenting membership of the AREA COORDINATING COMMITTEE, the REGIONAL COUNCIL OF PLANNING, and the REGIONAL COUNCIL OF ENGINEERING, established by part III,A and IV,A of this agreement, to represent such other agencies public or private as the committee may deem to be in the public interest, (3) consider the establishment of a citizens' advisory committee and make such provisions for action as it deems appropriate, (4) consider the establishment of an Executive Board to act for and in behalf of the AREA COORDINATING COMMITTEE. A. The counties signing this agreement and the cities ratifying this agreement do hereby agree, specifically, to the establishment of, and do hereby establish, a REGIONAL COUNCIL OF PLANNING composed, initially, of the Planning Directors (or equivalent) of each of the counties and each of the cities. They do further agree that this REGIONAL,COUNCIL OF PLANNING may be augmented by the AREA COORDINATING COMMITTEE as provided for -3- 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 i 25 26 27 28 29 30 31 in part II,C,(2) of this agreement. This Council will consider the establishment of an Executive Committee to act for and in behalf of the REGIONAL COUNCIL OF PLANNING. B. This Council is authorized to enlist the services of technical planning personnel to perform regional planning coordinating functions specified in Item E below. The functions specified are in no way intended to usurp or impinge upon the planning responsibility for any phase of planning for any agency with planning authority, in or beyond the study area, but are intended only to accomplish a meaningful coordination of local planning activities. C. Services of such personnel will be enlisted from the staffs of local agencies solely on the basis of specific and voluntary agreement of such local agencies, with no commitment in this regard being intended or implied by execution or ratification of this agreement by any party. D. This Council is authorized to investigate possibilities for financing the services of personnel referred to above in performing regional coordinating planning functions specified. Such possibilities will include, but need not be limited to, Housing and Home Finance Agency 701 grants in aid. This Council may make recommendations to the Area Coordinating Committee established in part II hereof; as to administrative arrangements and/or agreements by which financing of the services specified may be accomplished, but utilization of 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 voluntary services for performance of specified functions is not to be construed as necessarily contingent upon securing such financial assistance. E. Specified Functions: (1) To coordinate and relate the work and results of land use planning under way in the region in order to develop a composite regional land use plan and future land use estimates by assimilation of local planning components. (2) To coordinate local plans and future estimates and, in the process, identify regional problem areas, (3) Through such coordinating activities attempt to provide an adequate base of quantitative and policy information in order that data input for such studies as the LARTS Study (Section VI) that may be based thereon will be responsive to, and reflect the desires and plans of, local jurisdictions: (a) Develop future estimates and spatial distributions of population, employment and dwelling units by type, with due regard for economic factors and forces affecting growth and development. (b) Analyze, and evaluate control regulations (zoning, subdivision regulations, building codes, etc.) for impact, consistency, compatibility, etc., as a basis for recommendations and as a basis for im- provement in growth prediction.techniques. (c) Consider such social and community -value -5- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 IV. factors as open space, recreational facilities, historical sites, environ- mental amenities and aesthetic considera- tions in relation to growth, development, and improvement programs, including circulation systems, in a regional frame of reference, and make evaluations and recommendations relating thereto. A. The counties signing this agreement, and the cities ratifying this agreement do hereby agree, specifi- cally, to the establishment of, and do hereby establish, a REGIONAL COUNCIL OF ENGINEERING, to be composed, initially, of either the County Road Commissioner or Director of Public Works, or the City Engineer (or equivalent) of each of the counties, and each of the cities, respectively, and do further agree that the Council may be augmented by the Area Coordinating Committee as provided in part II,C(2) of this agreement. They do further agree, however, that the Area Coordinating Committee, at the meeting referred to in Part II,C, of this agreement, or at any later meeting, may designate the Metropolitan Trans- portation Engineering Board in lieu of the above Regional Council of Engineering, for performance of functions specified below. This Council will consider the establishment of an Executive Committee to act for and in behalf of the Regional Council of Engineering. B. The functions specified are in no way intended to usurp or impinge upon the responsibility of any phase of engineering for any agency with this authority, but are intended only to accomplish a meaningful coordination of com- prehensive transportation planning in the LARTS area. C. Specified Functions: (1) The review and updating of circulation systems, their physical and operational characteristics, traffic control devices and related regula- tions. (2) The review, updating, and estimation of future requirements for terminal and transfer facilities, including all forms of parking facilities at major centers. (3) The review, analysis, and application of traffic engineering features, including techniques and regulations, aimed at maximum safety and utilization of circulation systems. (4) The updating, review, and analysis of past, present, and planned disbursements for circu- lation systems, in relation to source and adequacy of revenues, revenue laws, and their expenditure provisions. A. The valuable contribution of the existing LARTS Advisory Committee (and Study .Director) to cooperative, coordinated transportation planning in the area is acknowledged and the jurisdictions authorizing present representation thereon are respectfully invited to continue this representa- tion in order that the Committee may perform its necessary continuing function within the framework established by this agreement. B. This committee is requested to continue to actively coordinate general planning and transportation planning aspects of the continuing planning process at the operational level: (1) To review and evaluate the results of studies undertaken jointly or separately by LARTS or the Regional Council of Planning or the Regional Council of Engineering, or both; (2) To advise and make recommendations with regard to proposed studies, to either the preceding groups or the Area Coordinating Committee as appropriate; (3) To base their recommendations upon the members' intimate knowledge of the operational procedures and working arrangements by which planning and/or engineering is accomplished in the area; (4) To provide liaison between the LARTS, the Regional Council of Planning, the Regional Council of Engineering and other such broadly based representative groups. A. The technical accomplishments of the Los Angeles Regional Transportation Study (LARTS) are acknowledged by the parties hereto,and the California Department of Public Works, by execution of this agreement,does agree to the continuation of the LARTS which will provide the means whereby the inventories and analyses of the transportation elements of the coordinated com- prehensive planning process may be accomplished. The continued financial and technical participation of the U. S. Bureau of Public Roads and the Housing and Home Finance Agency will be sought, as well as the technical counsel of the Automotive Safety Foundation. B. The District Engineer, District VII, Division of Highways, shall continue to serve as Study Director of the Los Angeles Regional Transportation Study, shall be responsible for the staffing and direction of the Study, and will make periodic reports to the LARTS.Advisory Committee and the Area Coordinating Committee, C. The transportation elements to be inventoried and analysed will include, but will not necessarily be limited to, (1) Transportation facilities including informal, tion on physical features and operational characteristics, 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 (2) travel patterns, current and projected., by mode and purpose, (3) terminal and transfer facilities, their adequacy and effectiveness, and relation to present and future land use, (4) traffic engineering and control features and their relation to capacities of existing and future facilities. D. The LARTS will provide study procedures for investigating the region as a whole, while retain- ing the identity of, and data pertaining to, Individual local communities; it will offer methods and means whereby more effective community and regional transportation and general planning may be realized. VII. This agreement may be ratified by any city wholly or partially within the LARTS area, as defined herein, which shall by resolution of its governing body agree to be bound by its provisions and deposit a certified copy of such resolution with the Director of Public Works,' State of California. In the event of such ratification, the Director of Public Works shall Forthwith notify al], other parties. IN WITNESS WHEREOF, the initial parties have ,executed this agreement by their respective officers, duly authorized, on the dates indicated. -10- RESOLUTION NO. 2408 RESOLUTION OF THE CITY COUNCIL, CITY OF REDLANDS, CALIFORNIA IN THE MATTER OF RATIFICATION OF AGREEMENT BETWEEN DEPARTMENT OF PUBLIC WORKS OF THE STATE OF CALIFORNIA, COUNTIES OF LOS ANGELES, ORANGE, SAN BERNARDINO, RIVERSIDE, VENTURA, SOUTHERN CALIFORNIA RAPID TRANSIT DISTRICT, RATIFYING CITIES, ET AL The City Council of the City of Redlands hereby resolves: That the agreement dated August 24, 1964, between the Counties of Los Angeles, Orange, Ventura, San Bernardino, Riverside, the California Highway Transportation Agency, the Southern California Rapid Transit District, and such cities as shall ratify the agreement in accordance with its terms, which provide organizational and working arrangements for a continuing coordinated comprehensive transportation planning process in the Los Angeles Regional Transportation Study area, is herewith ratified effective the date of execution of the agreement by the Department of Public Works; and the City Clerk of the City of Redlands is authorized to deposit a certi- fied copy of this resolution with the Department of public Works, State of California, as provided in said agreement.
