ORDINANCE NO. 1300
AN ORDINANCE OF THE CITY OF REDLANDS GRANTING TO LEROY C. GISH A
FRANCHISE TO OPERATE AUTHORIZED EMERGENCY AMBULANCE VEHICLES FOR
A PERIOD NOT TO EXCEED TWENTY YEARS, OVER, ALONG AND UPON THE
STREETS OF THE CITY OF REDLANDS, AND RESCINDING ORDINANCE NO. 1200
The City Council of the City of Redlands does ordain as follows:
SECTION 1. A franchise is hereby granted to LeRoy C. Gish, here-
inafter sometimes referred to as "Grantee", to operate authorized
emergency ambulance vehicles over, upon and along the streets of the
City of Redlands, subject to the provisions and conditions of this
ordinance.
SECTION 2. The term of this franchise shall be for the period of
twenty (20) years, unless sooner terminated, and shall be subject to the
right of the City to terminate or alter or amend said franchise at any
time as hereinafter provided.
SECTION 3. If the Grantee shall at any time fail to comply
with or fulfill the terms or conditions of this franchise, the City
Council may by ordinance revoke this franchise. Failure of the Grantee
to furnish adequate service by reason of strikes, lockouts, war, riot
civil commotion, inability to acquire equipment, parts, fuel, lubri-
cant, drivers or other causes beyond the control of the Grantee, shall
not be a violoation of the terms of this franchise.
If any term or condition of this franchise shall be or become in-
valid or unenforceable, the City Council may by ordinance terminate
this franchise, provided the City Council shall find and declare that
the invalid or unenforceable term or condition constituted a considera-
tion material to the grant of this franchise.
SECTION 4. All vehicles used under this franchise shall be opera-
ted and maintained in accordance with the laws of the State of Califor-
nia, and the ordinances of the City.
SECTION 5. The Grantee of this franchise, by acceptance of the
same, agrees with the City to charge such rates for ambulance service
as may from time'to time be prescribed by the City, by resolution.
SECTION 6. The City of Redlands shall have the right to regulate
the operation of the Grantee in the following respects:
(a) To make reasonable orders respecting character, extent,
quality and standard of service.
(b) To fix rates of operation, and to make reasonable orders
respecting the same.
(c) To make such other rules and regulations as may be reason-
ably necessary to facilitate the service to be rendered to
the public under this franchise, including establishment
of emergency call districts.
SECTION 7. The Grantee must have a valid permit and the drivers,
operators and attendants of the authorized emergency ambulance shall,
at all times, be qualified pursuant to the requirements of the Vehicle
Code of the State of California.
SECTION 8. Neither this franchise, nor any interest therein shall
be sold, assigned or disposed of, either by merger or consolidation, or
otherwise without the consent of the City expressed by ordinance.
SECTION 9. The City hereby expressly reserves the right to modify,
amend, alter, change or eliminate any of the provisions of this franchise
during the life of the same, for the following purposes, to wit:
(a.) To eliminate or delete from the same such conditions as
prove obsolete or impractical.
(b) To impose such additional conditions upon the Grantee as
may be just and reasonable, such conditions to be those
as may be deemed necessary for the purpose of insuring
adequate service to the public.
SECTION 10. In the interest of public health, safety and welfare,
the Grantee shall not operate any ambulance unless and until the follow-
ing conditions have been met:
(a) No station wagon or panel trucks, except appropriately
constructed carry -all type; vehicles approved by the
Chief of Police may be used.
(b) Ambulances may be inspected at irregular intervals at
the discretion of the Chief of Police.
(c) Grantee shall secure and maintain, at all times a policy
or policies of insurance in the following categories and
minimum amounts: Bodily injuryliability and property
damage liability in the amount not less than the amounts
stipulated by the Public Utilities Commission. The
Grantee shall file certificates of evidence of such
coverage with the City Clerk.
(d) Ea-ch ambulance unit shall carry at least one resuscitator,
one "E" size cylinder of oxygen and other First Aid and
medical supplies necessary to render emergency care to
patients.
(e) A driver and attendant shall respond to all calls. Such
drivers and attendants shall possess or comply with the
following:
(1) Advanced American Red Cross First Aid Certificate,
or Advanced First Aid Certificate issued by United
States Bureau of Mines.
(2) Statement or certificate of health issued by a licensed
physician or surgeon whereby it is indicated that the
person examined is free from contagious or communicable
diseases. Such statement or certificate shall be
renewed every six (6) months.

(3) Have on file with the Redlands Police Department
his photograph and fingerprints for identification
purposes.
(4) Ambulance Driver or Attendants' permit issued by the
Police Department.
( � Records required in (1) and (2) above will be on
file with the Grantee and the Redlands Police Department.
(6) Grantee shall at all times keep one ambulance
available and prepared for such emergency service
as the City shall require.
(7) The Grantee shall maintain a distincitve color
scheme with the name of the company on each side
and rear door of each ambulance unit, together
with a legible identification number not less
than 4" high.
SECTION 11. The City Council of the City of Redlands declares that
public convenience, necessity and welfare require a minimum of one
ambulance, to be maintained by the franchise holder, such ambulance to
be based and operative within the City Limits of the City of Redlands,
together with necessary crew available for unit. In the event the
Uxisting franchise holders fail to provide such minimum ambulance re-
quirements or fail to abide by any term of this franchise, the City shall
upon such determination notify the Grantee in writing and the Grantee
shall have ten days to increase service to minimum standards. If the
Grantee fails, the City may grant an additional franchise.
SECTION 12. Subject to future revision by resolution of the City
Council, the rates and charges for ambulance service shall comply with
the rate schedule adopted by the San Bernardino County Hospital and shall
not exceed such maximum charges. It shall be unlawful for any ambulance
operator to give directly or indirectly, or cause to be given, any re-
bates, commissions, reserve rebates, or any reduced rates or cash dis-
counts to any person or persons, or to any groups, except as provided
herein. A schedule of such rates shall be posted in a conspicuous
place within each ambulance.
SECTION 13, To promote the public interest in the establishment
and operation of an efficient ambulance facility, the City of Redlands
shall provide the following assistance to Grantee:
(a) To pay 4135.00 per month to Grantee.
(b) To supply gasoline from the City's gasoline storage
facilities at cost, with such fuel to be provided to
Grantee only by employees of the City and to be used
only for operating ambulances in accordance with this
ordinance within the boundaries of the City of Redlands.

(c) To provide mobile units of the radio system of the
Police Department for use by Grantee only for the
operation of ambulances in accordance with this ordi-
nance, City will provide normal maintenance of the
mobile units. Cost of any repair or replacement
beyond normal wear and tear will be Grantee's expense.
The City will provide maintenance for Grantee's base radio
station, as this is the Police Department's primary method
of requesting ambulances.
SECTION 14. The granting of this franchise is conditional upon
the Grantee's filing with the City Clerk at least ten (10) days before
the ordinance granting the franchise becomes effective, of a written
acceptance thereof and agreement to comply with the terms and condi-
tions herein set forth.
SECTION 15.
(a) Whenever in this ordinance any right or power is
conferred upon, or duty imposed upon, the City,
such right and power shall inure to and be exercised
by, and such duty shall be imposed upon the City
Council.
(b) This franchise shall not constitute an exclusive grant
of any right to conduct ambulance services within the
City.
SECTION 16. This ordinance is declared to be an emergency measure
for the preservation of the public health and safety in accordance with
the provisions of the Government_ Code of the State of California.
SECTION 17. The City Clerk shall certify to the adoption of this
ordinance and cause it to be published once in the Redlands Daily Facts
This ordinance shall take effect immediately upon its adoption.

(a) To pay such amount per month as the parties
may .six by mutual agreement.
SECTION 2. This ordinance is declared to be an emergency
measure for the preservation of the public health and safety in
accordance with the provisions of the Government Code of the State
of California.
SECTION 3. The City Clerk shall certify to the adoption of
this ordinance and cause it to be published once in the Redlands
Daily Facts. This ordinance shall take effect immediately upon its
adoption.

CHARGED WITHIN THE CITY OF REDLANDS
THE CITY COUNCIL OF THE CITY OF REDLANDS DOES RESOLVE AS FOLLOWS:
SECTION ONE: Under the provisions of Section 5, Ordinance No.
1300, of the City of Redlands, the City Council of the City of
Redlands hereby prescribes the following rates for ambulance service
within the City of Redlands:

amended to read as follows:

Gish and Elvis Swindle, a partnership, hereinafter sometimes
referred to as "Grantee", to operate authorized emergency
ambulance vehicles over, upon and along the streets of the
City of Redlands, subject to the provisions and conditions
of this ordinance.
Section Two: This ordinance shall be in force and take effect
as provided by law.
Section Three; The City Clerk shall certify to the passage of
this ordinance and shall cause the same to be published once in the
Redlands Daily Facts, a newspaper designated for that purpose.
