COVENANT RUNNING WITH THE LAND,+�;
THIS AGREEMENT, made and entered into this 18th day of November,

1965, by and between the CITY OF REDLANDS, California, a municipal
corporation, hereinafter referred to as Party of the First Part, and

J. Wilson Heard, Marguerite Heard and Iva Goodrich, hereinafter referred
to as Parties of the Second Part.
II
Parties of the Second Part state that they are the owners of
property located at :21-and 23 W. Colton Ave., in the City of Redlands;
which property is legally described as the West 44 feet of Lot 9 of
McGinnis Subdivision.
III
The City of Redlands, Party of the First Part, hereby consents to
the present location of exterior windows on the west wall of the
building on the herein -described property now owned by Parties of the
Second Part, but only on the express condition and covenant of Parties
of the Second Part that they will close all such windows or other open-
ings on the west wall of their building by cement block construction to
conform will all requirements of the Uniform Building Code in the event
that at any future time any structure on the adjoining property to the
west is caused to be Located any distance closer to the west property
line of Parties of the Second Part than the now existing set back.
IV
Parties of the Second Part hereby enter into a covenant running
with the ].and and agree that, if at a future time any structure on the
adjoining property to the west of their property is caused to be
located any distance closer to the west property line of the Parties of
the Second Part than the now --existing set back, then said Parties of the
Second Part hereby expressly enter into a covenant running with the land
and agree to close by cement block construction all such windows or
other openings on the west wall of their herein -described property to

conform with the Uniform Building Code then in effect in the City of
Redlands.
V
The above covenant in each and every particular is hereby declared
to run with the land and shall be construed as a real covenant running
with the land azid the said Parties of the Second Part, their heirs,
assigns, grantees and successors in interest hereby agree to observe and
keep this covenant.
