WITNESSETH:
THIS AGREEMTT, made and entered into this , f/ day
of / �, 196 7, by and between THE ATCHISON,
TOPEKA AND SANTA FE RULWAY COMPANY, a Kansas corpor—
ation, hereinafter designated "Santa Felt, and the
CITY OF RLDUNDS, a municipality, in the State of
California, hereinafter designated "City".
IMMEAS the Public Utilities Commission, State of California,
has ordered that flashing light signals be installed at the Tennessee
Street crossing of Santa Fe track (designated by said Commission as Cross..
ing No. 2U.-7.8 ).
Nal THEREFORE IT IS AGREED by the parties hereto as follows:
1. Santa Fe shall install aforesaid .flashing light signals
at the Tennessee Street crossing, removing the existing crossing protection.
2. Such work shall be performed as soon as practicable, con—
sidering availability of materials and manpower, and in consideration
thereof the City will pay to Santa Fe, as its share of the cost thereof,
one—half of the actual total cost which total cost is presently estimated
by Santa Fe to be TEN THOUSAM TWO HUNDRED TEN (Ep10,210.00) Dollars.
Santa Fets contribution toward the total cost of the work sha11 be applied
first toward any replacement or relocation involved.
3. That upon completion of the work specified in Paragraph 1
of this agreement, Santa Fe will render City a bill for its portion of the
costs and City will promptly reimburse Santa Fe for such costs.
4. That all work covered by this agreement shall conform to
requirements of the Public Utilities Commission of the State of California.
5. After installation of railroad crossing protection signals
and appurtenances under terms of this agreement, Santa Fe shall physically
maintain same so long as they remain in place. The maintenance cost of
said signals and appurtenances shall be divided in the same proportion as
the cost of constructing such automatic grade crossing protection as pro-
vided in Section 2 hereof, in accordance with Section 1202.2 of the California
Public Utilities Code.
6. The ownership of all materials used or placed in connection
with the work specified in Paragraphs 1 and 5 hereof shall be in Santa Fe.
IN WITNESS WHEREOF THE CITY OF REDLANDS has caused these
presents to be executed and attested by its duly qualified and authorized
officials pursuant to authority regularly granted them by its City Council
and THE ATCHISON, TOPEKA AND SANTA FE RAILWAY CTMPANY has executed these
presents both as of the day and year first above written.
