HomeMy WebLinkAboutContracts & Agreements_137-2019FIRST AMENDMENT TO AGREEMENT TO PUBLIC WORKS CONSTRUCTION CONTRACT This first amendment ("First Amendment") to the Public Works Construction Contract dated June 4, 2019 ("Contract") by and between the City of Redlands, a municipal corporation ("City"), and PK Construction ("Contractor"), is made and entered into this 16th day of July, 2019 RECITALS WHEREAS, it is the desire of City and Contractor to amend their existing Agreement, specifically to amend the Scope of Work and Contract Sum of the Agreement, and WHEREAS, the City Council approved the Agreement with Contractor for work in accordance with the Contract Documents for City's TDA 2013/14 & 2017/18 Transit Stop Access Improvement Project, Project No 47115 NOW, THEREFORE, City and Contractor hereby agree as follows AGREEMENT Section I Article 1 of the Agreement is hereby amended to include the additional scope of services more particularly described m Exhibit "A," entitled "Scope of Work " Section 2 Article 2 of the Agreement is hereby amended to increase Contractor's compensation and shall read as follows "THE CONTRACT SUM City shall pay Contractor the sum of ninety nine thousand nine hundred twenty seven dollars ($99,927) as consideration for its performance of the Work m accordance with the terms and conditions set forth in the Contract Documents Pursuant to Public Contract Code Section 22300, Contractor has the option to deposit securities with an escrow agent as a substitute for retention of earnings requirement to be withheld by City pursuant to an escrow agreement as set forth in the Public Contract Code Section 22300 " Section 3.
