HomeMy WebLinkAbout8001Recording requested by and when recorded return to CITY CLERK'S OFFICE CITY OF REDLANDS P O BOX 3005 REDLANDS, CA 92373 FEES NOT REQUIRED PER GOVERNMENT CODE SECTION 6103 Electronically Recorded in Official Records, County of San Bernardino BOB DUTTON ASSESSOR RECORDER CLERK 367 City of Redlands Clerk Doc# 2019-0241076 11111111111111 01111111111111 Titles 1 Fees Taxes CA SB2 Fee Others 7/18/2019 1057 AM SG Pages 9 00 00 00 00 Paid (THIS SPACE FOR RECORDER'S USE ONLY) RESOLUTION NO 8001 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDLANDS FINDING THAT A PORTION OF PARK AVENUE IS UNNECESSARY FOR PRESENT OR PROSPECTIVE STREET PURPOSES AND ORDERING THE VACATION OF A PORTION OF SAID EXCESS RIGHT-OF-WAY (CITY OF REDLANDS STREET VACATION NO 167) WHEREAS, Shaw Development Partners, LLC, as an agent for the property owner for 1675 Park Avenue, has submitted an application requesting vacation of a portion of excess right- of-way, approximately 597 linear feet in length, adjacent to the frontage of the parcel located at 1675 Park Avenue (APN 0292-158-15-0000) in the EV/IC (Commercial Industrial) District of the East Valley Corridor Specific Plan, and WHEREAS, the City is authorized to vacate all or part of a public street or public service easement within the City pursuant to the Public Street, Highway and Service Vacation Easements law (State of California Streets and Highway Code, Section 8300 et seq ), and WHEREAS, pursuant to Section 8340 of the California Streets and Highway Code, the City may for public convenience and necessity reserve and except public service easements from a street vacation, and WHEREAS, at its April 9, 2019 meeting, the Planning Commission made a determination that the street vacation conforms to the City's General Plan, and WHEREAS, on June 18, 2019, the City Council of the City of Redlands adopted Resolution No 7991, declaring its intention to vacate such portion of Park Avenue, described in Exhibit A, attached, and set a public hearing date and time for the proposed vacation, and WHEREAS, the proposal qualifies for exemption from environmental review in accordance with the California Environmental Quality Act (CEQA), pursuant to Section 15061(b)(3) of the CEQA Guidelines for projects where there is no possibility of any environmental effects, and WHEREAS, pursuant to section 8320 of the Streets and Highways Code of the State of California, the City Clerk of the City of Redlands subsequently caused the publishing of notices 1 I \Resolutions\Res 8000 8099\8001 Street Vacation 1675 Park Avenue.doc 00 in the Redlands Daily Facts, for two successive weeks prior to the hearing, and the posting of notices along the lines of the portion of right-of-way at least two weeks prior to the date set for the public hearing, no more than 300 feet apart, with at least three notices posted, and WHEREAS. on July 16, 2019, the City Council held a duly noticed public hearing on the proposed vacation and considered all verbal and written testimony provided by persons interested in the proposed vacation, THE CITY COUNCIL OF THE CITY OF REDLANDS hereby resolves as follows Section 1 The proposed vacation of a portion of street right-of-way is exempt from environmental review m accordance with the California Environmental Quality Act (CEQA), pursuant to Section 15061(b)(3) of the CEQA Guidelines Section 2 The City Council of the City of Redlands, having elected to proceed under the provisions of Division 9, Part 3, Chapters 1 through 3, inclusive, of the Streets and Highways Code of the State of California, and having held a public hearing as provided therein, hereby finds from all evidence submitted that a portion of excess right-of-way, approximately 597 linear feet in length, adjacent to the frontage of the parcel located at 1675 Park Avenue (APN 0292- 158-15-0000), and as more specifically described in Exhibit "A" attached hereto and made a part hereof (the "Right -of -Way") is unnecessary for present or prospective public use and that the public interest and convenience require the vacation of that portion of the Right -of -Way and the termination of the public right to use the Right -of -Way Section 3 The City Council hereby orders the vacation of a portion of the Right -of - Way described in the attached Exhibit "A" and depicted on the attached Exhibit `B " Section 4 Pursuant to Section 8340 of the Streets and Highways Code of the State of California, m connection with the vacation of a portion of the Right -of -Way described in the attached Exhibit "A," the City of Redlands reserves and excepts from such vacation a permanent easement for in-place public utility facilities that are in use as of the effective date of this resolution to maintain, operate, replace, remove, and renew such m -place utilities in, upon and over the portion of the Right -of -Way proposed to be vacated Section 5 Pursuant to Section 892 of the Streets and Highways Code of the State of California, the portion of the Right -of -Way proposed to be vacated is not useful as a non -
