HomeMy WebLinkAboutContracts & Agreements_15-1986_CCv0001.pdf AGREEMENT For CONSULTING SERVICES SOUTHEAST REDLANDS SPHERE OF INFLUENCE SPECIFIC PLAN May, 1986 Prepared by: NESTE, BRUDIN & STONE INCORPORATED Civil Engineers SanDiego--San Bernardino--fiemet California AGREEMENT THIS AGREEMENT, made and entered into this 6th day of May —, 1986, by and between the The City of Redlands, A PUBLIC AGENCY, hereinafter referred to as the "AGENCY," and NESTE, BRUDIN & STONE INCORPORATED, duly licensed Civil Engineers-Planners of San Bernardino, California, hereinafter called the "Engineers." WITNESSETH: WHEREAS, said Agency proposes the preparation of a Specific Plan for the Southeast Redlands Sphere of Influence portion of the City of Redlands; and WHEREAS, said Agency desires to engage the Engineers to perform certain Engineering and Planning Services pertinent to the above Specific Plan; NOW THEREFORE, in consideration of the premises and mutual ben- efits which will accrue to the parties hereto in carrying out the terms of this Agreement, it is mutually understood and agreed as follows: SCOPE OF WORK The Engineers agree to provide Engineering and Planning Services as follows for the Specific Plan. Task 1.0 - Program Management and Organization Objective - Prepare a management and organization plan detailing work tasks, timing and man-power assignments. 1.1 Develop a Specific Plan Program responsive to the goals and objectives as set forth. 1) Identify issues, objectives, and goals. 2) Identify Key Personnel responsible for work projects. 3) Identify specific work products. 4) Develop progress reporting procedures and establish time goals. 1.2 Review, modify and refine Specific Plan Program as required. 1) Review Program for total project with City and others as deemed appropriate. 2) Prepare revisions, additions or deletions to program. 1.3 Prepare and maintain program schedule. 1) Select time frames and milestones responsive to total project schedule. 2) Monitor work and prepare progress reports. 3) Prepare project management schedule that establishes an agreed upon detailed scope of work and provides for scheduled events and time frames. Task 2.0 - Data Base Objective - Collect, analyze and evaluate existing background data, general plan, special studies and reports and conduct preliminary investigations to: 0 Obtain knowledge and understanding of the project area characteristics and regional relationships. 2 o Determine project area constraints and opportunities through examination and analysis of collected data. o Identify planning and development issues including soils, environmental setting, slope gradients and grading concepts, circulation, drainage, and municipal improvements. 2.1 Inventory Regional and Local Data 1) Obtain available project information pertinent to the project boundary, parcelization, land uses, easements and reservations affecting develop- ment, etc. 2) Obtain City of Redlands reports, its general plan, and development policies applicable to the study area. 3) Review City of Redlands and other agency plans to determine growth and development strategies, including population forecasts, that affect the study area. 4) Review City, Districts, County and State agency plans to determine present funding strategies for planned infrastructure facilities, timing, location, capacity, anticipated demands and improvement design requirements (as available). 5) Obtain topographic, slope gradient, hydrologic, soils, geologic and ecologic data applicable to the project area. 2.2 Identify Project Area opportunities and constraints 1) Prepare a series of maps or exhibits at a scale (as yet undetermined) with graphics for the project area depicting a real distribution and locational aspects of natural conditions, and man-made or planned improvements, including limiting factors, such as topographic and soil conditions. 2) Prepare map overlays depicting general land uses, physical opportunities and constraints, including plans of adjacent jurisdictions and services boundaries of all special districts and servicing agencies. - 3 - 3) Organize and tabulate acreages based on suitability for development, residential density and principal land uses. 4) Assemble and review innovative ordinances, rural and equestrian design guidelines, and studies from other jurisdictions and professional organizations. Task 3.0 - Alternative Land Use Plan Concepts Objective - Prepare and evaluate land use concepts with the City of Redlands. 3.1 Land Use Planning criteria 1) Identify, based on Task 2.0, interpretations, locations suitable for residential, commercial and recreational, institutional, and open space uses, and development intensity options, including destination resort opportunities. 2) Prepare a list of urban design concepts meeting the City of Redlands development objectives. 3) Prepare preliminary planning concepts and guidelines establishing locational criteria for circulation, drainage, utilities, open space/conservation networks, bridle trails, water storage, and other municipal services facilities. 3.2 Land Use Plan Concepts 1) Prepare land use concept exhibits using desired development objectives and physical planning and urban design criteria. 2) Evaluate land uses, community facilities and infrastructure within the project area and regional setting. 3) Prepare land use concepts for hillside development densities and design requirements and review with the City. Consider innovative grading concepts, maintenance districts for encouraging rural life style, low density cluster projects with private open space/recreation facilities and large lot residential subdivisions. 4 4) Modify and refine up to three land use concepts resulting from City review. 5) Interpret and quantify all and use concepts and estimate population, acreage, dwelling units, and intensity of development necessary to establish municipal facilities requirements. 3.3 Presentation of Land Use Plans 1) Establish contact with affected City of Redlands commissions, citizen groups, community leaders and others interested in the project. 2) Provide interested parties with appropriate information. 3) Obtain citizen feedback and maintain written records of meetings. 3.4 Land Use Plan selection process 1) Review and consider all comments and recommendations and review with City of Redlands. 2) Refine preliminary land use plan alternatives and prepare exhibits and descriptive reports for each setting forth plan assumptions, community goal objectives and municipal facilities circulation, timing, location advantages, and phasing options. A preferred plan will be recommended to Planning Commission and/or City Council. 3) Attend Planning Commission and City Council meetings and present land use planning proposals as requested. Planning Commission and/or City Council chooses preferred Land Use Plan. Task 4.0 Specific Plan Preparation Objective Prepare and complete a specific plan in accordance with the provisions of Section 65450 et. seq. of the Govern- ment Code for the preferred land use plan alternative. 4.1 Draft Outline 5 1) Prepare detailed outline of specific plan to establish content, format, organization and topical elements. 2) Review outline with City of Redlands. 3) Expand, modify and revise outline. 4.2 Prepare Development Master Plan Elements 1) Prepare a land use plan and development design standards which locates and establishes development areas specifying all principal land uses and sub-classifications necessary and practical to determine development capacity limits, and a statistical summary of land uses. 2) Prepare circulation plan which identifies and establishes arterial streets and highway alignments, classifications, off-site street improvements and bridle trail design standards. 3) Prepare open space/conservation plan which identifies natural open space, public and/or private parks and recreational open space facilities, such as golf courses, equestrian centers, linear greenbelt corridors and trails. 4) Prepare preliminary municipal services plans which identify plans of facilities depicting preliminary location, alignments and sizes of backbone improve- ments including water, sewer, public drainage and utility systems. 5) Prepare community design master plan which identifies natural boundaries of land uses and promotes connections, landscape image, grading and erosion criteria, focal, theme and visual guidelines. 6) Prepare a phasing plan that identifies timing, location of infrastructure improvements triggered by the sequence of development. 4.3 Prepare Narrative Specific Plan Sections 1) Prepare written text following authorized outline. 2) Prepare a draft of the Specific Plan including maps, illustrations and graphics for review with the City of Redlands. 6 4.4 Complete Draft of Specific Plan 1) Review with the City and obtain comments; then revise Specific Plan accordingly. 2) Prepare final Specific Plan suitable for Planning Commission and City Council hearings and adoption. Task 5.0 - Adoption Procedures 5.1 Present Specific Plan to Planning Commission and City Council. 5.2 Revise Specific Plan in accordance with Planning Commission's and City Council's directions. TIME SCHEDULE The following project time schedule presents our perception of the time required to accomplish identified tasks. It is expected that the duration allowances indicated may ultimately require reconciliation and adjustment. NB is fully prepared to meet the schedule goals as may be established by the City. FEE Task Cost No. Task Description Estimate 1.0 Project Management $ 700 and Organization 2.0 Data Base and Maps 5,100 3.0 Alternate Plan Concepts 12,800 4.0 Specific Plan Preparation 18,900 5.0 Adoption Procedures 3,200 TOTAL LUMP SUM FEE $ 40,700 METHOD OF PAYMENT The Agency shall pay the Engineer the fee as set forth in the Fee Section in the following manner: Payments shall be made monthly for the services performed and billed, based upon the percent of the services completed. EXTRA WORK The Agency will pay the Engineers for additional services, when authorized in writing by the Agency, as performed by personnel assigned to the regularly established office of the Engineer at the prevailing hourly billing rates per Exhibit "A" attached hereto, plus the actual cost of reimbursable expenses. CANCELLATION OR SUSPENSION OF CONTRACT The Agency shall have the right to cancel or suspend the Contract by giving the Engineers fifteen (15) days written notice to that effect. If such cancellation or suspension shall take effect during the performance of an uncompleted phase, the Engineers shall be paid the reasonable value of the work completed. 8 Ilk ATTORNEYS' FEES - In the event of any legal action to enforce the provisions oT-Uhils— Agreement, the prevailing party shall be entitled to reimbursement of costs and reasonable attorneys' fees from the other party. COPIES OF FINAL REPORT The Engineers shall deliver to the Agency twenty (20) sets of the final report.
