HomeMy WebLinkAboutContracts & Agreements_5-2008_CCv0001.pdf FIRST AMENDMENT TO ENVIRONMENTAL IMPACT REPORT FUNDING AGREEMENT This first amendment (this"First Amendment") to the Environmental Impact Report Funding Agreement dated August 7, 2007(the "Agreement"), by and between the City of Redlands, a municipal corporation (hereinafter"City"), and On Texas Street, LLC, a Delaware limited liability company(hereinafter"Applicant"), is made and entered into this 15`" day of January, 2008. RECITALS WHEREAS, it is the desire of the City and Applicant to amend Section I of their existing Agreement, entitled "Funding Obligation." NOW THEREFORE, the Agreement between City and Applicant is hereby amended to read as follows: "Section 1. Funding Obligation. Within ten (10) days of the date of written request of City, Applicant shall deposit the sum of Eighty-Eight Thousand dollars ($88.000) (the "Deposit") with City to engage the consultant who will commence work on the FIR. The estimated cost of the EIR is Four Hundred Seven Thousand Eight Hundred One dollars ($407,801.00) which includes the sum of Three Hundred Thirty- Nine Thousand Eight Hundred Thirty-Four Dollars ($339,834.00) as the estimated fee for the consultant's work and the sum of Sixty-Seven Thousand Nine Hundred Sixty-Seven dollars ($67,967,00) as the estimated administrative costs which will be incurred by City. The Deposit will be applied towards the total cost of the EIR. Applicant shall thereafter make payments to City for the balance of all other costs and expenses for preparation of the EIR within ten (10) days of the date City Submits written invoices to Applicant." Section 2. All other provisions of the Agreement shall remain in full force and effect. Tract No. 17064 - Winstar Redlands, LLC - Final Approval - On motion of Councilmember Gilbreath, seconded by Councilmember Gallagher, the City Council unanimously granted final approval for Tract No. 17064, a subdivision of approximately 5.6 gross acres into 12 numbered lots and one lettered lot for a planned residential development located on the southwest comer of Wabash Avenue and Capri Avenue. Tract No. 17533 - Rose Villas, LLC - Final Approval - On motion of Councilmember Gilbreath, seconded by Councilmember Gallagher, the City Council unanimously granted final approval for Tract No. 17533, a subdivision of 4.68 acres into ten lots for property located on the south side of San Bernardino Avenue, the west side of Grove Street and the north side of Sherry Way. Funding Agreements - Redlands Commons Project - On motion of Councilmember Gilbreath, seconded by Councilmember Gallagher, the City Council unanimously approved the first amendment to the contract with EIP Associates for preparation of an Environmental Impact Report for the Redlands Commons Project located on approximately 68.93 acres bounded by the 210 Freeway, Texas Street, San Bernardino Avenue and Pioneer Avenue and authorized the Mayor to execute, and the City Clerk to attest to, the document on behalf of the City. On motion of Councilmember Gilbreath, seconded by Councilmember Gallagher, the City Council unanimously approved the first amendment to the funding agreement with On Texas Street LLC for preparation of an Environmental Impact Report and City administrative fees for the Redlands Commons Project located on approximately 68.93 acres bounded by the 210 freeway, Texas Street, San Bernardino Avenue and Pioneer Avenue, and authorized the Mayor to execute, and the City Clerk to attest to, the document on behalf of the City. Robinson Ranch Project - At the request of Councilmember Gallagher, Interim Community Development Director Dalquest reviewed the letter prepared by staff in response to the Notice of Preparation of an Environmental Impact Report for the Robinson Ranch Project located in the City of Yucaipa that depicts our concerns. Staff will continue to monitor the project and has requested a copy of the Draft Environmental Impact Report to review and comment when it is completed. Councilmember Gallagher moved to acknowledge receipt and ordered filed the City's response to the Notice of Preparation of an Environmental Impact Report opposing the Robinson Ranch Project located in the City of Yucaipa.
