HomeMy WebLinkAboutContracts & Agreements_15-1968�,J-1 11 .4b_ AGREMEENT This agreement is entered into between the UNIVERSITY OF REDL�_NDS, hereinafter known as the "Institution," and the CITY OF REDLANDS, REDL_MS, CALIFORNIA, hereinafter known as the "Agency," a public organization within the meaning of that term as defined in section .2(g) of the regulations governing the College fork -Study Program, for the purpose of providing work to students eligible to participate in the College Work -Study Program. WHEREAS, Institution and Agency desire that certain of University's students engage in work for public and private non-profit organizations under the Fork -Study Program authorized by the Economic Opportunity Act of 1964, Public Law 88-452, 78 Stat. 573, as amended. NOWT, THEREFORE, the parties hereto agree as follows: 1. Agency shall utilize the services of students furnished by the University who are eligible to participate in the Work -Study Program and who are qualified and acceptable to Agency. The specific services to be performed by said students are set forth on the attached Exhibit "A", which is incorporated herein. 2. The work performed by such students shall be in public interest and shall not: a. Displace employed workers or impair existing contracts for services; b. Involve political activity or work for any political party; or c. Involve the construction, operation, or maintenance of so much of any facility as is used or is to be used for sectarian instruction or as a place for religious worship. 3. Agency agrees to: a. Reasonably supervise the services of students participating in the Work -Study Program and permit reasonable supervision by a represent- ative of the Institution; b. Make a report to Institution of the time worked by students participating in the programs at least monthly; o. Allow no student to work for more than fifteen (15) hours in any week in which classes in which he is enrolled are in session, for not more than forty (40) hours in any other week; and d. "Pay to Institution the Agency's share of total compensation, excluding all employee benefits, to be paid to students in the program not to exceed twenty (20%a) percent of the total compensation to be paid to each student. Should the Agency's share of the total compensation as required by the provisions of the College Work -Study Program at any time exceed twenty (20o) percent of the total compensation to be paid to the students participating therein, this agreement may be terminated at any time without notice by the Agency without further liability for such compensation." 4. Compensation to be paid to students participating in the program will be appropriate and reasonable in light of the work to be performed by them. 5. The services and benefits of Agency which involve the work of such students shall be available to all persons regardless of race, color, or national origin. No student shall be denied participation in the Work -Study Program because of race, color, or national origin. 6. Institution will be responsible for all employee benefits, unless otherwise agreed by the parties hereto in writing. 7. This agreement shall be subject to the availability of funds to Institution for the portion of the student's compensation not to be paid by Agency. It shall also be subject to the provisions of the Economic Opportunity Act of 1964, the regulations adopted thereunder, and all legislation and regulations pertaining to the Work --Study Program adopted subsequently. 8. This agreement may be cancelled by either party if there is a failure to comply with the provisions of the agreement. 9. This agreement shall terminate .tune 30, 1969, unless sooner terminated, and shall be subject to extension by the mutual agreement of the parties hereto in writing. 10. The Institution shall be deemed the employer for purposes of this agreement. It has the ultimate right to control and direct the services of the student for the Agency. It shall also determine that the students meet the eligibility requirements for employment under the College Work -Study Program, assign students to work for the Agency, determine that the students do perform their work in fact, and disburse the appropriate amounts to them. The Agency's right shall be limited to direction of the details and means by which the result is to be accomplished. Compensation of students for work performed on a project under this agreement will be paid by the Institution. All payments due as an employer's contribution under State or local workmen's compensation laws, under Federal or State social security laws, or under other applicable laws, will be made by the Institution.
