CALIF. 00 THIS CDVENANT, dated the�day ofr'! i� , is made and entered by and between THE CITY OF REDLANDS, hgreinafter called "CITY" and hereinafter called "OWNER" as a covenant Run ing With The Land. Recitals 1, Owner owns the real property situate in the County of San Bernardino, State of California, described on Exhibit A attached hereto,') and incorporated as a part of this covenant, and hereinafter referred to as t'property". 2. Owner desires to obtain a domestic family dwelling water/sewer connection to the Redlands Domestic Water System/Sewerage System. FOR AND IN CONSIDERATION of the covenant contained herein the City and the Owner agree as follows: 1. That Owner may make a connection to the Redlands Domestic Water System/Sewerage System for a domestic family dwelling subject to the terms, conditions, and requirements of all ordinances, resolutions, rules, and rates adopted by the City, and performance by Owner of the covenants herein. 2. That Owner shall annex property to the City of Redlands no later than 120 days after the City makes a written request for such annexation by personal delivery to Owner or by registered letter, deposited at a United States Post Office, bearing the following address= Owner: ...r_ Address s 42 6'- _ 3. That Owner shall be charged and pay twice the water/sewer rates established by City ordinance or resolution for service to properties situate outside City upon Owner's failure to consent to annexation of property no later than 120 days after the request to do so. The rates which shall be doubled in the event of Owner's refusal BOOK7108 FASE 83 to annex shall be the outside rates in effect on the 121st day after the City's request for annexation. 4. That this covenant shall be recorded in the office of the County Recorder of San Bernardino County, a covenant running with the land described herein, which covenant shall obligate and be binding upon Owner, his assigns, transferees, executors, trustees, and every other successor in interest. / 5. It is understood by both parties that this larger meter is ,.w provided to supply the necessary water service for the existing facility and any expansion of this non -conforming use will be cause for cancellation of water service. NEW BUSINESS Resolution No. 2616 - Approving agreement for Federal Aid Resolution Emergency Relief for flood damage to Alabama Street in No. 2616 1966 - adopted on motion of Councilman Martinez, seconded by Councilman DeMirjyn. Resolution No. 2617 - Approving the including of Lugonia Resolution Avenue, from Orange Street west to the proposed Tennessee No. 2617 Street Freeway, in the Federal -Aid Secondary Highway System, adopted on motion of Councilman DeMirjyn, seconded by Councilman Martinez. CITY MANAGER Manager Merritt presented a request from the Mission Trailer outside park for an increase in water meter size from 1" to 2". After Water discussion, Councilman DeMirjyn moved that the requested. Service increase be made with the stipulation that this is for the existing facility and not for any planned expansion. Motion seconded by Councilman Martinez and carried. Council discusses the recurring flooding problem on Alabama Street and concluded that efforts should be made to expedite the section of the Foothill Freeway planned to cross the Foothill Santa Ana Wash and connect with the Tennessee Street Freeway !Freeway off -ramp. on motion of Councilman DeMirjyn, seconded by Councilman Martinez, the staff was requested to prepare a resolution urging the cooperation of other agencies in bring- ing this matter to the attention of the State Division of Highways. This resolution to be presented at the meeting of September 5, 1967. Mr. Michael Hesser of the Chamber of Commerce requested that Travel Council authorize placement of "Traveler Information" signs information on City property adjacent to the freeway at the Alabama and Signs' Ford Street off -ramps. These are to be lighted signs which will be furnished by the Chamber of Commerce. Following lengthy consideration, on motion of Councilman Martinez, seconded by Councilman DeMirjyn, this proposal was referred for study. On motion of Councilman DeMirjyn, seconded by Councilman Grant Deed Martinez, a grant deed to the City from the University of Sixth - Redlands for the property located on the northeast corner Citrus of Citrus and Sixth, was accepted with the City Manager authorized to execute the certificate of acceptance in behalf of the City. A Grant Deed from the Redlands Community Hospital to the City Grant Deed in connection with the closing of Laurel Avenue, accepted on Community motion of Councilman Martinez, seconded by Councilman De Hospital Mirjyn with the City Manager authorized to execute the certificate of acceptance in behalf of the City.
