THIS AGREEMENT by and between the CITY OF REDLANDS,
a municipal corporation of the State of California, hereinafter
called "City", and HOWARD L. BARNETT, hereinafter called "Barnett",
is dated this A day of 1968.
Recitals
1. Howard L. Barnett is the owner of all right, title,
and interest in the lease, dated November 12, 1964, effective
December 1, 1964, and all options to renew such lease of certain
real property in the City of Redlands, County of San Bernardino,
State of California, which property is more particularly described
on Exhibit A attached to this Agreement and incorporated as a part
hereof.
2. The City desires to acquire Barnett's leasehold in-
terest and all options to renew such lease in the property
described on Exhibit A.
Agreement
For and in exchange for the assignment and transfer
to the City of Redlands of all of Barnett's right, title, and
interest in the leasehold, all options to renew such lease,
interest on the real property described on Exhibit A, the City
agrees as follows:
1. To pay to Barnett the sum of Four Thousand and Five
Hundred Dollars ( $4, 500 .00) .
2. To allow Barnett to occupy the real property from the
date of this Agreement until he desires to vacate or until May
31, 1969, whichever time occurs sooner, for the same purposes
for which it has been used during the term of his lease, and
to pay rental to the City of $150.00 per month; provided that
Barnett may continue to use said property for such purposes
under the following conditions:
(1) Barnett's use of the property for the
three months following the date of execution
of this Agreement shall be without charge
and no rent shall be required by the City.
(2) Barnett shall pay rent of $150.00 per
month to the City for the fourth month and
each month thereafter until the property is
vacated or until May 31, 1969, whichever
time occurs sooner.
(3) Barnett shall make each monthly payment
of rent on the first day of the month for
which rental is being paid.
3. To allow Barnett to remove such personal property or
fixtures as he may have a legal right to take from the real
property described on Exhibit A, provided that Barnett shall
not be required to remove any structure from the premises, and
further provided that Barnett shall have completely ceased his
use of the premises, and vacated them, no later than 8:00 o'clock
A.M. on June 1, 1969.
In witness whereof the parties hereto have executed
this Agreement on the day of 1968.
