TEIS AGREENENT, made this 20th day of December, 1956, by and between the
City of Redlands, California, a municipal corporation, first party, and Roy V. Shutt
of Calimesal California, second party,
OTTNESSETH:
The parties hereto for the term of one (1) year commencing on the 1st day
of January, 1957, and ending on the 31st day of December, 1957, do hereby agree as
fol3ows.
That the said first party in consideration of the covenarts on the part of
the said second party herein contained, hereby agrees with the said second party,
to allow and permit second party to have an exclusive contract for collection of
approximately one (1) ton of garbage per day, six (6) days a week from restaurants,
hotels, markets, schools and hospitals within said City of Redlands under the
supervision of the City Disposal Superintendent, said second party to use his awn
equipment and employees in collection of said garbage.
That the second par* in consideration of the said covenants on the part
of the first party, agrees to and with the said first party, to collect approxi-
mately one (1) ton of garbage a day from restaurants, hotels, markets, schools
and hospitals within said. City, six (6) days per week, with his own equipment and
employees under the direction of the Disposal Superintendent as above set forth,
and that said second party will pay to the said first party, or its order, the sum
of Fifteen Dollars ($15.00) per month, payable in advance on the 10th day of each
month in said term.
That it is mutually agreed that this contract may be cancelled and abro-
gated by the first party, said City of Redlands, upon First Party serving to
Second Party a thirty (30) day notice in writing of its intention to cancel said
contract°
It is mutually understood that the said First Party will be diligent in
its efforts to prevent any other party during the term of this contract from col-
lecting green cuttings or garbage from restaurants, hotels, markets, schools and
hospitals within the City, provided, however, that the within contract is in full
force and effect.
Second Party agrees to post the sum of One Hundred Dollars 0100.00) with
said First Party, in lieu of a faithful performance bond, and agrees to forfeit
the same to First Party should he fail to perform under the terms of the within
contract in a good and workmanlike manner to the satisfaction of the City Disposal
Department
B WITNESS 1 HEREOF, The City of Redlands has caused its corporate name
to be subscribed by the Mayor and the City Clerk and has caused its corporate
seal to be attached, as First Party, and the said Roy V. Shutt has hereunto
placed his hand and seal, as Second Party.
