HomeMy WebLinkAboutContracts & Agreements_5-1969CONTRACT THIS AGREEMENT, made this 10th day of March 1969, by and between the City of Redlands, California, a municipal corporation, hereinafter referred to as the "City" and Redlands Auto Dismantlers referred to as "Contractor". WITNESSETH: The parties hereto for the term of one (1) year commencing on the loth day of March 1969, and ending on the 10th day of March agree as follows: 1970, do hereby That the City in consideration of the covenants on the part of the Contractor herein contained, hereby agrees with the said Contractor to allow and permit him to have an exclusive contract for collection and disposal of abandoned, wrecked, dismantled or inoperative vehicles or parts thereof, so declared in accordance with provision of City of Redlands Ordinance No. 1381, with his own equipment and employees within said City of Redlands. That the Contractor in consideration of the said covenants on the part of the City, agrees to and with the City, to collect and dispose of abandoned, wrecked, dismantled or inoperative vehicles or parts thereof, so declared in accordance with provisions of City of Redlands Ordinance No. 1381, with his own equipment and employees and that said Contractor will pay to the City, or its order, the sum of five dollars ($5.00) for each vehicle with a year of manufacture prior to 1960, and determine, through negotiation with the City, an equitable sum for each vehicle manufactured in 1960 or subsequent years. CONTRACT That it is mutually agreed that this contract may be cancelled and abrogated by either party upon service of thirty (30) day notice in writing of its intention to cancel said contract. That the Contractor shall exercise this contract subject to the order of the City Director of Building and Safety and shall follow no practices or methods for removal expressly prohibited by said Director. The Contractor shall maintain such insurance as will protect him from claims under Workmen's Compensation Acts and such Public Liability insurance as will protect him and the City from any claims for damages for bodily injury, including death, and damage to property including property of others, which may arise from operations under this Contract, whether such operations be by himself or by any subcontractor or anyone directly or indirectly employed by either of them. Certificates of such Work- men's Compensation and Public Liability Insurance shall be filed with the City and shall be subject to his approval, and the amounts of such insurance coverage shall be as follows: Comprehensive General Public Liability, in an amount not less than $100,000.00 for injuries, in- cluding accidental death, to any one person, and subject to the same limit for each person, in an amount not less than $300,000.00 on account of one accident, and Property Damage in an amount not less than $100,000.00. The Contractor shall require all subcontractors engaged by him on the work to maintain such insurance as will protect such subcontractors from claims under Work- men's Compensation Acts and Public Liability. CONTRACT The Contractor agrees to save harmless and to indemnify the City from every claim or demand which may be made by reason of a. Any injury to person or property sustained by the Contractor or by any person, firm or corporation employed directly or indirectly by him upon or in connection with his work, however caused; and b. Any injury to person or property sustained by any person, firm or corporation, caused by any act, neglect, default, or omission., of the Contractor or of any person, firm or corporation, directly or indirectly employed by him or in connection with his work, whether the said injury or damage occur upon or adjacent to the work, and the Contractor, at his own cost, expense and risk shall defend any and all actions, suits, or other legal proceedings that may be brought or instituted against the City on any such claim or demand and pay or satisfy any judgment that may be rendered against the City in any such action, suit or legal proceedings or result thereof. IN WITNESS WHEREOF, the City of Redlands has caused its corporate name to be subscribed by the City Manager and the City Clerk and has caused its corporate seal to be attached, and the said City Manager, R.
