THIS AMENDMENT TO AGREEMENT, amde and entered into this 1st
day of July , 1969 by and between the COUNTY OF SAN
BERNARDINO, a body corporate and politic of the State of California,
hereinafter referred to as the "County", and the CITY OF REDLANDS,
a municipal corporation of the State of California, hereinafter
referred to as the "City".
WITNESSETH
WHEREAS, there exists, between the County and the City, an
agreement for the division of costs for improvements on Tennessee
Street between the limits of Park Avenue on the north and the Morrey
Arroyo drainage channel on the south, and
WHEREAS, the division of costs and method of payment for pro -
section at the crossing of Tennessee Street and the Southern Pacific
Company tracks is specifically mentioned and agreed to, and
WHEREAS, a separate, tri-partite agreement is required by the
Southern Pacific Company and the State of California Public Utilities
Commission between the railroad, County, and City covering the
division of the costs of providing protection at the crossing, and
WHEREAS, the existing agreement between the County and the
City would be in conflict with the required agreement between the
Southern Pacific Company, the County, and the City.
NOW THEREFORE, the parties hereto agree to amend the agreement
as follows:
1. The line in paragraph 2, Section (a), which reads: "For
railroad crossing protection 50% of the City, County share."
2--Amendment to Agreement
is hereby declared invalid and stricken from the agreement.
The said stricken line is also identified as lines 11 and
12 of Page 2 of the said agreement.

On the motion of Superviso4likO'Sell , duly seconded by SupervisorBet.terlcy
and carried, the fallowing resolution is adopted:
WHEREAS, flashing lights are considered necessary to provide for the
safe movement of traffic at the Southern pacific Company crossing of Tennessee
Street., No. BP-546.5; and
WHEREAS, this Board has previously agreed with the City of Redlands to
participate in this installation; and
WHEREAS, the Southern pacific Company desires to proceed with the
installation of these flashing lights and has submitted an agreement pro-
viding for their installation; and
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of the County
of San Bernardino that, it hereby approves and authorizes its chairman to sign
that amendment to agreement by and between the County of San Bernardino and
City of Redlands dated .Italy 1, 1969, covering division of costs for railroad
protection at the Tennessee Street crossing of the Southern Pacific C ,zany
tracks No. Bp-546.5.
BE IT FURTHER RESOLVED that: the County Engineer is directed to transmit
copies of this resolution and agreement to the City of Redlands.
PASSED AND ADOPTED by the Board of Supervisors of the County of San.
Bernardino, State of California, by the following vote:
