HomeMy WebLinkAboutContracts & Agreements_3-1970 AGREMENT FOR ENGINEERING SERVICES PREPARATION OF DESIGN PLANS , SPECIFICATIONS, AND COST ESTIMATES FOR CONSTRUCrION OF BRIDGE AND ROADWAY APPROACHES ACROSS SAN TIMC32EO CREEK This Agreement made this 17rh day of February 1970 , between the CITY or REDLANDS, a Municipal Corporation, hereinafter referred to as 'CITY; Yr and KING & KING, Consulting Engineers, a sole proprietorship, of Ontario, California, hereinafter referred to as uENGINEER; WITNESS. TT THAT: WHEREAS, CITY has need for engineering services for the preparation of final design plans, specifications, and cost estimates for a bridge and roadway approaches across San Tirc►oteo Creek in the vicinity of Fern Avenue in the City of Redlands; and WHEREAS, ENGINEER is willing and able to undertake and perform such services; NOW, THEREFORE, the parties hereto agree as follows: 1. In consideration of a fee to be paid by the CITY hereinafter stipulated, the ENGINEER hereby agrees to render engineering services as follows a. Sake field surveys. b. Obtain complete foundation exploration borings to ascertain subsurface conditions and allowable footing bearing pressures Or pile design criteria. c. Prepare preliminary plans showing basic geometric and structural design criteria proposed for final design for review and approval by the CITY and other interested agencies. 1 . Prepare preliminary cast estimates. e. Ater approval of preliminaryl CITY and other interested agencies, commence with and prepare detailed contract plazs, specifKations, and estimates in a form SOWN to the C17Z. Maintaincontinuous liaison i °a CITY and other interested agencies. g. Present oral progress reports to CITY duri, design of the project. h. Furnish up to fifty () sets of reduced Mal plans a Upon quest by the CITY, furnish adequate inspection of constructioa, including construction stakeout, testing and assistance with liaison, chance orders, shop draw- ings, as-builts, and pzugress pay estimates. . ENGIKEER intends to engage SerViCeS of De LeUw, Cather and compagy, Consulting Engineers, San Francisco, California, in connection with the bridge structural design and speci.- fication. . For the purpose of n, the reqUiredz l rin services are divided into phases as follows PHAw i - rnginRering services outliaed in paragraph1, subparagraphs a, b, ct d , 6, f, g, and h . PHASE 11- ygineering services outlined in paragglQ_ 1, subparagraph i, when and if so ordered by the CITY. 4 , For the services outlined in PHASE I, the CITY shall pay the ENGINEER in accordance with the following pro- visions: a. CITY shall reimburse ENGINEER a sum equal to A S.C.E. Manual No. 45, Curve B-1967, for Basic Services, which includes services outlined in paragrap a 1, subparagraphs c, d, e, f, g, and h. b. Reimburse actual payments by ENGINEER, at cost, for foundation investigation and soils and laboratory tests. c. Reimburse ENGINEER for field surveys at a rate of $31.00/hour far a two-man survey party. d. If CITY demands changes in the design after CITY has approved the preliminary plans, CITY will reimburse ENGINEER at direct wages, p1 us one hundred twenty-five percent (125%) to cover payroll overhead, for services performed to make the necessary modifications in the design plans an.d specifications . 5. For services outlined in PHASE II , the CITY shall pay the ENGINEER a fee to be negotiated in accordance with the schedules and procedures as outlined in Manual No. 45, American Society of Civil Engineers, and executeu by supple- mental agreement. In the event the CITY and the ENGINEER fail to agree on a mutually acceptable fee, then CITY and ENGINEER are relieved of all obligations to continue PHASE II services . 6 . Payment for engineering services shall be evade by CITY monthly, based on progress reports ubmitte d by ENGINEER and approved by the CITY ENGINEER. 3 7* .ENGINEER ,ails. complete PHASE I services by June 22, 1970, provided that approvals and cognents on the preliminary alignment, profile, and structural, layout do not require more than fifteen (15) calendar guys after submission to the CITY. IN WITNESS WHERLOP, the parties hereto have executed this Agreement on the day firsts above written, in. the County of San Bernardino, California.
