RECITALS WHEREAS, it is the desire of City and Consultant to amend. their existing Agreement to change the scope of services to be provided by Consultant; NOW, THEREFORE, the Agreement between City and Consultant is hereby amended as follows: Section 1. Exhibit"A" of the Agreement is hereby amended to include within its scope of services to be performed by Consultant revisions to the Traffic Study, Air Quality Study, Noise Study and the text in the Preliminary Draft EIR based upon recent changes in the site design of the Redlands Mall Redevelopment Project. Section 2. The additional work to revise the Traffic Study, Air Quality Study,Noise Study and the text in the Preliminary Draft EIR shall be prepared for a total cost of Thirty Thousand Four Hundred Dollars ($30,400.00), as more fully detailed in the attached Exhibit "N' to this Third Amendment. The compensation to be paid to Consultant under the Agreement shall be increased by such amount. Section 3. All other provisions of the Agreement shall remain in full force and effect. CITY 0 REDL DS ATTEST: f Harrison, Mayor Lorrie/Poyzer, S6ta to RBF CONSULTING By: Garystrot)-4- Senig�r tce President I)JNI'-,Agreemeiii��RBF—At'neiid I EXHIBIT "A" AMENDMENT NO. 3 SCOPE OF WORK CHANGES TO PROJECT DESCRIPTION WARRANT NEW/ADDITIONAL TRAFFIC, AIR QUALITY, AND NOISE ANALYSES, AND CONSISTENCY CHANGES IN PRELIMINARY DRAFT EIR On February 28, 2007, RBF Consulting (RBF) attended a meeting at the City with City of Redland Staff and representatives from Hopkins Real Estate Group, General Growth Properties, and Village Partners to go over comments on the Administrative Draft EIR, GGP. At that meeting, the development team presented a new site plan for the project. The revised site plan has necessitated an update to the EIR project description, a consistency review and update of the entire EIR, and additional traffic, air quality, and noise analyses. This task will be added to the following section in the Scope of Work. Part 2, Environmental Impact Report, Task 2.5C, Traffic and Parking. The scope description below will be added to the end of Task 2.5C, Traffic and Parking, following the Addition of Five Study Intersections (Second Amendment). Revisions to Traffic Analysis The RBF Team attended a meeting on February 28, 2007 with Hopkins, GGP, and City of Redlands staff to discuss preliminary results of the traffic and parking analysis for the Redlands Village Town Center (VTC) Project. Traffic and parking analysis was included in the following two documents: • Redlands Village Town Center Project Traffic Impact Analysis (RBF Consulting, October 31, 2006); and • Redlands Village Town Center Project Parking Analysis (RBF Consulting, January 5, 2007). The preliminary traffic analysis included 17 mitigation measures based on project site plan information provided by the project applicant consisting of approximately 230 proposed dwelling units, approximately 220,000 square feet of proposed shopping center land uses, and approximately 140,000 square feet of displaced shopping center land uses. Results of the traffic and parking analyses were based on interaction with City Staff including a meeting in August 2006, City Staff provided written comments on the traffic and parking analyses in April 2007. Based on the February meeting and the April written comments, the traffic and parking analyses need revision to account for the following items: • Revised project site plan and refined land use totals for proposed and displaced land uses. • Add section to identify conditions of approval for approved projects in the downtown area, and potential consistency with mitigation measures identified for the Redlands VTC project. • Add onsite trip capture calculations to account for compatibility and interaction between land uses proposed as part of the project. A-1 • Determination and potential inclusion of benefit to traffic signal operation at study intersections related to signal progression project underway by Albert Grover and Associates. • Where applicable at General Plan intersections, add section to identify improvements in excess of project-required mitigation measures to achieve acceptable intersection level of service (LOS) operation. Note mitigation measures required for the proposed project may eliminate a significant traffic impact, but may not necessarily achieve acceptable operation (LOS C or better). • Include in traffic analysis planned and funded improvements to study intersections such as improvements at the 1-10 Eastbound Ramps/Eureka Street intersection. • Calculation of fair share percentages for each mitigation measure based on City provided formula. • Removal of shared parking evaluation from parking analysis to account for "secured" or "guaranteed" parking associated with residential component of proposed project. • Ensure parking analysis is consistent with recent refinements to the City parking ordinance allowing for modified parking rates requirements. Task 1: Revise Traffic Impact Analysis RBF will revise the traffic impact analysis (TIA) to account for the revised project site plan and the refined land uses totals for proposed and displaced land uses. Assuming provision of conditions of approval for other approved projects in the project vicinity, a table will indicate consistency between project-related traffic mitigation measures and conditions of approval. The trip generation calculations will be revised to include an onsite trip capture calculation based on the methodology included in the Institute of Transportation Engineers (ITE) Trip Generation Handbook (2" Edition), RBF will coordinate with Albert Grover and Associates to determine if the traffic signal progression project includes an estimated benefit at improved traffic signals for inclusion in the study. Additionally, the traffic study will include a section identifying the project proportionate share of each mitigation measure utilizing the City of Redlands formula. The fee for Task 1 is $17,150. Task 2: Revise Parking Analysis RBF will revise the parking analysis to remove the shared parking evaluation and identify the parking spaces "secured" for residential uses within the proposed project. The study will include a parking review to identify parking supply required for the proposed project based on City code and determine if the proposed parking supply is adequate to satisfy applicable City of Redlands zoning requirements. Additionally, RBF will interact with City Staff to ensure the parking analysis is consistent with the recently refined parking ordinance potentially allowing for shared parking or reduced parking requirements for specific land uses or parking types such as guest parking. The fee for Task 2 is $2,000. Fee For Additional Work for Task 2.5C: $19,150 A-2 This task will be added to the following section in the Scope of Work: Part 2, Environmental Impact Report, Task 2.5D, Air Quality. The scope description below will be added to the end of Task 2.5D, Air Quality, following the subheading Meetings/Public Hearings. Revisions to Air Quality Analysis LSA Associates will update the air quality analysis to correspond to changes made in the Traffic Impact Analysis. The revisions include updating the local (carbon monoxide) and regional air quality emission estimates using the revised traffic data; and updating the local significance threshold (LST) calculations to include fine particulate matter less than 2.5 microns in diameter. The fee for this task is $1,500. This task will be added to the following section in the Scope of Work. Part 2, Environmental Impact Report, Task 2.5E, Noise. The scope description below will be added to the end of Task 2.5E, Noise, following the subheading Meetings/Public Hearings. Revisions to,Noise Analysis LSA Associates will update the noise analysis to correspond to changes made in the Traffic Impact Analysis. The revisions include updating the on-site traffic and stationary noise impacts based upon the revised site plan; and updating the noise impact analysis using the revised traffic data. The fee for this task is $1,500. This task will be added to following section in the Scope of Work: Part 2, Environmental Impact Report, Task 3.1, Preliminary Draft EIR. The scope description will be added to the end of Task 3.1, Preliminary Draft EIR. Revisions to Preliminary Draft EIR/Change in Project Description Following the February 2007 meeting, RBF has been working with the development team to refine the project description and develop accurate existing and project buildout numbers. Several iterations of the project description were developed and reviewed by the development team and City staff to accurately determine gross and/or net square footages. A final set of numbers was agreed to by the applicant team and City Staff on June 11, 2007. The numbers agreed to in June 2007 vary from those used to generate the analysis presented in the Administrative Draft EIR (December 2006). RBF will need to review each EIR section and update the project description numbers and corresponding analysis to ensure consistency is achieved throughout the entire Preliminary Draft EIR.
