INSPECTION AND CONSTRUCTION OF BRIDGE AND
ROADWAY APPROACHES ACROSS SAN TIMOTEO CREEK
This Supplemental Agreement made this 25th day of
August___ , 1970, between the CITY OF REDLANDS, a
Municipal Corporation, hereinafter referred to as "CITY;" and
L. D. KING ENGINEERING CO., INC., a California Corporation,
of Ontario, California, hereinafter referred to as "ENGINEER;"
WITNESSETH THAT:
WHEREAS, under an Agreement dated February 17, 1970,
hereinafter referred to as "AGREEMENT," CITY and ENGINEER
arranged for engineering services for design and made contin-
gent arrangements for construction inspection services in
connection with a bridge and roadway approaches across San
Timoteo Creek in the vicinity of Fern Avenue in the City of
Redlands; and
WHEREAS, the design services described in the AGREEMENT
have been completed, and ENGINEER has delivered to CITY com-
pleted plans and specifications; and
WHEREAS, CITY has need for inspection services during
construction of said project, as covered by the plans and
specifications; and
WHEREAS, ENGINEER is willing and able to undertake and
perform such services;
NOW, THEREFORE, the parties hereto agree as follows:
1. INSPECTION OF CONSTRUCTION
ENGINEER shall furnish in cooperation with the CITY adequate
inspection of construction to insure execution of project
in accordance with the contract plans and specifications.
Such inspection shall include inspection of site constxuc-
tion operations as well as inspection of operations of
suppliers and manufacturers whose products are to be
incorporated in the project.
A. ENGINEER shall furnish the services of one inspector.
B. CITY shall supply supplemental inspectors for inspec-
tion of construction and inspection of operations of
suppliers and manufacturers as required, who shall be
satisfactory to ENGINEER. ENGINEER, together with
CITY, shall determine the amount of supplemental
inspection required.
C. ENGINEER shall furnish supplemental specialized inspec-
tion as required to include, but not be limited to,
structural. ENGINEER shall furnish inspection as
required at prestressed concrete plant.
2. TESTING
If such services are not otherwise provided for by CITY,
ENGINEER shall engage the services of a competent testing
laboratory satisfactory to CITY at a compensation rate
satisfactory to CITY bo perform such tests as in ENGINEER'S
judgment are required to insure satisfactory conformance
of materials to the requirements of the specifications.
3. CONSTRUCTION STAKEOUT
ENGINEER shall provide control stakeout of the project
providing necessary stakes to establish alignment, eleva-
tions, and references from which the Contractor or CITY,
if it so elects, can proceed with construction stakeout.
4. MONTHLY PROGRESS PAY ESTIMATES
A. ENGINEER shall prepare monthly reports setting forth
the quantities incorporated in the work and showing
monies earned by and due the Contractor at the end
of the month. Said forms shall be checked and then
delivered to CITY with recommendation for periodic

payments to the Contractor, all in compliance with
the Standard Specifications and the Special Provisions
to be issued for the project.
B. ENGINEER shall keep up-to-date books containing compu-
tations or other evidence of quantities of construction
materials incorporated in the work.
C. ENGINEER shall review claims which the Contractor may
present for additional compensation or additional
time allowance or any change or variation from the
construction contract and recommend proper action.
6. SEQUENCE OF CONSTRUCTION
ENGINEER shall advise the Contractor regarding the proper
sequence of construction operations to cause minimum
interference to traffic and shall enforce the applicable
paragraphs of the special provisions relating to the
sequence of construction operations.
7. CHANGE ORDERS
ENGINEER shall prepare change orders during the progress
of the work to cover necessary changes within the scope
of the construction contract.
8. SHOP DRAWINGS, AS -BUILT PLANS, AND FINAL DOCU14ENTATION
A. ENGINEER shall review, check, and approve all shop
drawings and working drawings submitted by the Con-
tractor as required by the terms of construction
contract.
B. ENGINEER shall maintain permanent on -site records of
approved deviations from the contract plans; and
after construction has been completed, shall correct
the original contract plans to reflect the as -built
conditions and shall deliver said original plans to
CITY for its permanent files. ENGINEER shall make

the final inspection of the entire facility and
prepare the recommendation for acceptance and final.
payment.
C. On completion of the project, ENGINEER shall deliver
to CITY all the job records, field books, the inspec-
tor's diary, final quantity computations used for
the monthly Contractor's pay estimates, scale tickets,
and similar material.
9. COMPENSATION
For the services to be rendered by ENGINEER as outlined
above in this Supplemental Agreement, CITY agrees to
reimburse ENGINEER in accordance with the following
provisions:
A. CITY shall reimburse ENGINEER at direct wages plus
one hundred twenty five percent (125%) to cover pay-
roll overhead for the inspection services furnished
in accordance with paragraphs 1 through 8 above of
this Supplemental Agreement. Direct wages shall be
determined by multiplying the employee's hourly rate
of pay by the number of hours worked.
B. CITY shall reimburse ENGINEER for field surveys at a
rate of $31.00/hour for a two -man survey party.
C. CITY shall reimburse ENGINEER for his direct invoice
cost (without additional mark-up) for material tests,
such as concrete cylinder breaks, tests of soils or
aggregate samples, etc., performed by testing labora-
tories.
D. CITY shall reimburse ENGINEER for design work in
preparation of change orders for services outside the
scope of the construction contract as requested by
CITY in writing at direct wages plus one hundred

twenty five percent (125%) to cover payroll overhead.
ENGINEER will not be reimbursed for design work or change
orders necessitated by ENGINEER'S errors or oversights.
E. Payment for engineering services will be made by CITY
monthly based on billings submitted by ENGINEER and
approved by the City Engineer.
IN WITNESS WHEREOF, the parties hereto have executed
this Supplemental Agreement on the day first above written,
in the County of San Bernardino, California.
