MAYNE, LABOR MANAGEMENT SUCCESS This agreement is made and entered into this 20"' day of June, 2000; by and be een t I bet he City of Redlands, hereinafter referred to as the"CITY" and Ren6e V, Mayne, hereinafter referred to as the"CON SULTANT". EFFECTINT DATES OF AGREEMENT I. This agreement is effective for the period of seven (7) months, from June 20, 2000, through January 19, 2000. The agreement may be renewed and revised upon mutual consent of both parties, CONTRACTOR STATUS I. The CONSULTANT shall act as an independent consultant in the performance of her duties and no officer, employee or agent of theCONSULTAN'T shall be deemed to an officer, employee or agent of the CITY, 1 The CONSULTANT shall be solely 'liable for and obligated to pkv directly all applicable taxes includiny,but not limited to federal and state income taxes, Social Security withholding(FICA). Medicare. state disability and unemployment insurance. In connection therewith, the CONSULTANT shall indem nifv and hold the CITY harmless from any and all liability=which consultant may incur because of CONSULTANT's failure to pay such taxes. 3. No offer or obligation of pennanent employment Nit h the CITY is intended nor implied in any manner by this contract agreement, The CONSULT T" shall not become entitled to benefits (health, Worker's Compensation, life, etc_)of any form, NO DISC RLIM][INATION 1- During the performance of services as outlined in this agreement, the CONSU­LTANT shall not discriminate against any person on the basis of their race, eth-nicity, gender, age, disability, religion, national origin, citizenship or sexual orientation. SCOPE OF SERVICES L In accordance with the direction of the City Council-, dufing the term of this agreement, the Consultant shall provide the CITY professional advice, and execute the process and final disposition of labor negotiations. 2 L The CONSULTANT shall ser-%-,e as chief negotiator for labor negotiations between the CITY and its six (6) employee units, 3, The CONSULTANT shall perform all necessary duties during the course of labor contract negotiations, which include: a. Gaining bargaining parameters and reporting status of negotiations to the City Council; b, Scheduling and attending all labor contract negotiations; c. Scheduling and attending all mediation and conciliation sessions-, d. Upon the request of the City Council, attending City Council executive session, e. Providing professional advice to the City Council regarding drafting of City contract proposals-, f Completing the administration and finalization of all signed labor contract agreements, 4. TheCONISULTANT shall provide the CITY, including the City Council, City manager, department heads, managers, supervFisors® one(1)day of training services in the areas of labor contract negotiations, contract administration, grievance handling and employee complaint resolution. 5. The CITY shall provide the following resources: a. Staff support in the areas of employee wage and benefit research, CITY budget, costs of labor proposals; clerical and word processing support; b- A conference room for negotiations with a side room for caucus meetings,, c. For onsite work, office space, phone and desk forCONSULTAINIT; & Laptop computer for CITY staff during negotiations-, e, Staff support at each negotiating table, which at the CITY`sdiscretion could include departmental representatives, Personnel or Administrative Staff- TIME OF PERFORMANCE 1, CONSULTANT shall typically render services betweenMonday and Friday during the term of the agreement. a. The scheduling of contract negotiations is subject to the availability of employee representatives, CITY staff and resources, and the CONSULTANT, Attachment A is an estimated schedule to demonstrate the CCT A? For economy purposes, upon mutual agreement between the CITY and the CONSULT:A T, the CITE may provide travel, hotel and meal arrangements for CONSULTANT, .
