AND HORACE HINCKLEY WATER TREATMENT PLANTS
AMENDMENT I
This Amendment No. I authorizes the ENGINEER to perform Engineering Services
included in this Amendment and in accordance with the AGREEMENT to Furnish
Engineering Services for the Preparation of Risk Management Plans for the Henry Tate
and Horace Hinckley Water Treatment Plants dated April 20, 1999.
This Amendment makes the following changes to the AGREEMENT (effective
January 4. 2000);all other provisions of the AGREEMENT remain in effect.
ARTICLE 1 —ENGAGEMENT OF THE ENGINEER
No changes.
ARTICLE 2—SERVICES OF THE ENGINEER
2.1 The Scope of Work is amended to include Attachment A to this
Amendment which defines the scope of work for engineering services.
ARTICLE 3—RESPONSIBILITIES OF CITY
No changes.
ARTICLE 4—PERIOD OF SERVICE
4.1 The time-period for performance of the ENGINEER'S services for
Amendment I set forth in Article 2 shall be in accordance with the
schedule defined in Attachment B to this Amendment.
ARTICLE 5—PAYMENT TO THE ENGINEER
5.1 The total compensation to perform the work under this Amendment
(Amendment 1) shall be in accordance with Attachments C and D to this
Amendment.
ARTICLE 6—INSURANCE AND INDEMNIFICATION
No changes.
ARTICLE 7—GENERAL CONSIDERATIONS
No changes.

SCOPE OF WORK
The scope of work to be performed includes the following:
I. Assist the City in holding a Public Meeting to share information about the local implications of
the City's Risk Management Plans (RMPs), including a summary of the Offsite Consequence
Analysis(OCA) for the Henry Tate and Horace Hinckley Water Treatment Plants prior to the
established regulatory deadline.
2. Assist the City in notifying the FBI prior to the established regulatory deadline that the City has
held the Public Meeting (as required under Item 1) for the Henry Tate and Horace Hinckley
Water Treatment Plants.
3. Assist the City in determining whether it will make the OCA data available to the Public
without restrictions for the Henry Tate and Horace Hinckley Water Treatment Plants.
4. If the City makes the OCA data available to the public without restrictions, then to assist the
City in notifying the EPA that it has made the OCA data available without restrictions for the
Henry Tate and Horace Hinckley Water Treatment Plants.
5. Assist City personnel in completing hazardous materials business plans (HMBPs) for all City
facilities (primarily well sites) by conducting a review of each HMBP prepared by city
personnel prior to submittal to the County.
6. Assist City facilities in compiling documentation for facilities which handle regulated
substances but which fall below the threshold quantities (the purpose is to ensure that for
facilities handling digester gas adequate documentation supporting why an RMP was not
prepared is compiled).
7. Perform an environmental compliance audit of the City facilities. The facilities to be audited
will include the Horace Hinckley Water Treatment Plant,the Henry Tate Water Treatment Plant
and several of the Well Sites. The number of well sites selected will be determined jointly and
will be selected in a manner that provides an adequate representation of all of the well sites.
8. Perform an OSHA compliance audit of the City facilities. The facilities to be audited will
include the Horace Hinckley Water Treatment Plant,the Henry Tate Water Treatment Plant and
several of the Well Sites. The number of well sites selected will be determined jointly and will
be selected in a manner that provides an adequate representation of all of the well sites.
9. Perform an RMP compliance audit for the Horace Hinckley Water Treatment Plant and the
Henry Tate Water Treatment Plant. The audit will focus on ensuring that all recommended
actions have been completed and implemented, that all standard operating procedures (both
operations procedures and administrative procedures) have been implemented, that personnel
have been trained, that all process safety information is current and up to date-, that the
preventive maintenance program has been implemented and that all records are maintained as
required.
10. Prepare audit reports for all audits conducted.
11. Assist the City in complying with the requirements of California Proposition 65 (making
recommendations for postings and signage).
12. Develop a Fire Prevention Plan for the Horace Hinckley Water Treatment Plant and the Henry
Tate Water Treatment Plant(and additional facilities if required).
The scope of work does not include the following:
• conduct of sampling activities;
• analytical expenses;
• any regulatory licensing fees or document review fees payable to Governmental Agencies;
• hazardous and non-hazardous waste handling and disposal fees(e.g.,the disposal of samples, etc,
if required);
• purchase of materials and supplies required to come into compliance(i.e., labels,drums,etc.);
• corrective actions required to come into compliance;and
• personnel training(e.g., if you ask RSM to actually put on a class for New Hires,OSHA 24 hour
training,etc.).
Resource Management Services is a full service environmental,health and safety consulting firm and if any
of these services are required, a separate scope of services and cost proposal will be submitted for each
required item. The need for these services will be more clearly identified and defined during the first
month of the project. These services,if needed,would be performed on either a time and materials basis or
on a fixed cost basis (depending upon the situation). Attachment D presents our Standard Schedule of
Fees. On time and materials projects, we try to provide a labor rate that is appropriate to the technical
nature and scope of the issue at hand. In most instances,technical labor utilized will range from $75 to$95
per hour.

FEE
Resource Management Services, Inc. (RSM) will perform the specified scope of services on a fixed cost
basis for a price of$19,000. Our fee includes all technical and clerical labor charges and other direct
expenses as well as all travel and per them expenses associated with performing the scope the services
specified herein. At the completion of the project the City will receive two copies of each Report or
Document prepared and ALL files will be provided in electronic format in MS Word(IBM format).
The project fee is payable in four equal installments to be billed per the following schedule:
