In view of the City's consent to allow the fence to remain on the aforementioned rights of way, Lockheed Propulsion Company agrees that at such time as the City desires to widen or improve the roads involved, at the City's request, Lockheed will remove the fence at its own expense. In addition, Lockheed will hold the City harmless from any claims arising from the construc- tion of the fence in its present location. Lockheed appreciates the City's cooperation in this matter.
