July 24, 1957, on Route 10 between Hunts Lane and east city limits of Redlands; 2. May 22, 1963, on Route 106 between Route 30 and Route 101 and WHEREAS, State and City have heretofore entered into a Freeway Agreement dated August 6, 1957, a Supplemental Freeway Agreement dated September 1, 1959, a Second Supplemental Freeway Agreement dated May 17, 1960, and a Third Supplemental Freeway Agreement dated May 2, 1961, relating to that certain portion of State Highway Route 10 between the west city limit (Kansas Street extended) and the east city limit (Wabash Street); and WHEREAS, the City has annexed County territory to the west and the westerly city limit is now located approximately 0.1 mile east of Nevada Street; and WHEREAS, a plan map has been prepared showing the proposed freeway plan of the State for Route 106 between Route 10 and the north city limit of Redlands (Santa Ana River) and a new plan for alterations to State Route 10 between the west city limit (0.1 mile east of Nevada Street) and Orange Street; and z 1 2 3 4 5 6 7 8 9 1❑ 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 WHEREAS, the prepared plan shows the proposed plan of the State as it affects streets of the City, including provisions for closing city streets, for carrying city streets over or under or to a connection with such freeway, for relocation of city streets and for construction of frontage roads and other local roads; NOW THEREFORE, it is agreed: 1. The City agrees and consents to the closing of city streets, relocation of city streets, construction of frontage roads and other local roads, and other construction affecting city streets, all as shown on the plan map attached hereto marked Exhibit "A" on Route 106 between Route 10 and north city limit (Santa Ana River) and on Route 10 between the west city limit (0.1 mile east of Nevada Street) and Orange Street. 2. That the plan map attached hereto marked Exhibit "A" shall supersede that portion of the plan neap marked Exhibit "A" attached to the Third Supplemental Freeway Agreement dated May 2, 1961, relating to that certain portion of State Highway Route 10 between the west city limit (Kansas Street extended) and orange Street, and become a part of this freeway agreement. 3. That except for the superseded portion the said Freeway Agreement dated August b, 1957, and supplements thereto, shall remain in full force and effect, unmodified by any provision of this agreement. 4. The State in the construction of said freeway will, at the State's expense, make such changes affecting city streets in accordance with the plan attached hereto or as the same may hereafter be modified by subsequent agreement between the parties hereto. The State may, at the State's expense, install signs, signals and other traffic control devices at appropriate locations to be determined by the State in order to regulate, -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 warn or guide traffic upon the highways. S. The State agrees to acquire all real property and interests in real property required for construction affecting city streets and the City authorizes the State to acquire in its behalf all such real property or interests in real property. 6. The City will accept control and maintenance over each of the relocated or reconstructed city streets and the frontage roads and other State constructed local roads on notice to the City from the State that the work thereon has been completed, except as to any portion thereof which is adopted by the State as a part of the freeway proper. The City will also accept title to the portions of such roads lying outside the freeway limits, upon relinquishment by the State. 7. The grade separations shown on said plan map attached hereto marked Exhibit "A" will be either undercrossings or overcrossings as detailed engineering studies may determine will best fit the locality. 8. It is understood that the freeway may be constructed in stages. 9. Present: Councilmen DeMirjyn, Knudsen, Miller, Sewall, Mayor Cummings; Deputy City Attorney Bill Brunickg Press: Chuck Palmer and Grant Sims 1. Tennessee Street Freeway - Agreement and Maps This being the time and place advertised for hearing on the maps, routing and agreement for the Tennessee Street Freeway► Mayor Cummings announced the meeting open as a public hearing. Mayor Cummings introduced Mr. R. E. Deffebach, Mr. H. C. Prentice, Mr. Fred Jackson, San Bernardino County Supervisor Don Beckord, Mr. Dennis Hansberger, and Mr. Martin Nicholas, County Highway Engineer, and stated that these gentlemen were present to answer any questions or offer recommendations. Speaking in favor of the adoption of the freeway at this time was Mr. Fred Ford, representing the Chamber of Commerce. Mr. Ford stressed the time factor as being of the essence and strongly urged approval. Also speaking in favor were -.Mr. Raymond A. Beeler, who presented a petition with 146 signatures requesting approval of the freeway at this time, Mr. Louis Fletcher and Mr. Hal Hagen, president of the Foothill Freeway Association. Speaking against the proposal in its present form was Mr. John Runkel, who requested better access for the properties on Alabama Street. Mr. R. E. Deffebach gave cost estimates, time projections, and answered questions presented by Mr. Knudsen and Mr. Sewall. He urged acceptance of the plan as here presented and recommended that negotiations for changes in offramps be included in the cover letter. Mr. Deffebach gave the opinion that the State would provide right- of-way for frontage roads both east and west. Councilman Sewall expressed concern for the impact on the ecology of the area by so large an interchange. Following further discussion, on motion of Councilman DeMirjyn, seconded by Councilman Miller, the City Council accepted the agreement and authorized the signing of the Freeway Agreement by the Mayor, with the following roll call vote: AYES: Councilmen DeMirjyn, Knudsen, Miller, Mayor Cummings NOES: Councilman Sewall ABSENT: None Council recessed for five minutes. At 3:30 P.M. the Council reconvened to consider the remaining matters referred to them by the Planning Commission. Council Action - Planning Page one -- April 20, 1971 PLANNING COMMISSION RECOMMENDATIONS (Continued) 2. Street Vacation No. 58 - Mobil Oil Corporation Application for vacation of the westerly half of a 15--foot alley located 110 feet east of Orange Street between High Avenue and Interstate 10 Freeway as requested by the Mobil Oil Corporation was recommended for denial by the City Council. Mr. Bob Wagner addressed Council with the request that as his client has met with the Dill family, who originated the objection to the street closure, and had come to an agreement, the matter be returned to the Planning Commission. On motion of Councilman DeMirjyn, seconded by Councilman Knudsen, the matter was referred back to the Planning Commission for hearing on the second Tuesday in May. 3. Lot S lit No. 419 - Curbing and Sidewalk Installation - Halsey Street A request by property owners that they be permitted to sign the improvement agreement for curbs and sidewalks on the property located on Halsey Street - Lot Split No. 419 -- was again brought to Council. Mrs. J. W. Simonds, Mr. George Fikrle, Dr. Gilbert Becker and Mrs. R. C. Oliver addressed Council. They spoke of the beauty of the street and requested that it be left as it is, for it presently discourages traffic, is used a great deal by neighborhood children, and is not used in any way for through traffic. Following very lengthy dis- cussion, Council approval was given for the signing of the agreement by the three property owners involved in the present lot split, Caruthers, Fikrle, and Simonds. Following this matter, Council briefly discussed the practi- cality of amending the ordinance to outline specifications for substandard streets in areas in which standard streets are impractical. 1, Alice G. A teberry, C of Engineering & Uti it Branch Division of Right of Way Attachment TRANSPORTATION COMMISSM RESOLUTION NO R2880 t UED BY %0C4xWt4%0 Zo TItANSPORTATtON coumf i " RELINQUISHMENT OF HIGHWAY RIGHT OF WAY IN THE CITY OF REDLANDS, ROAD 8-SBD-30-32.2/32.5 REQUEST NO. 366S WHEREAS, by freeway agreement dated April 20, 1971, between the City of Redlands and the State of California, the City agreed to accept title to reconstructed city streets upon relinquishment thereof to said City by the State of California; and WHEREAS, the State of California has acquired right of way for and has constructed the above -mentioned collateral facilities in the City of Redlands, at Pioneer Avenue Undercrossing and along new Tennessee Street between Pioneer Avenue and San Bernardino Avenue, road 8-SBd-30, in accordance with said agreement; and WHEREAS, in accordance with Section 73 of the Streets and Highways Code, a 90-day notice in writing dated December 30, 1987, of intention to relinquish the above -mentioned collateral 19 facilities was delivered to the City by certified mail return receipt on January 5, 1988, Article Number 95680; and WHEREAS, this Commission has found and determined, and does hereby find and determine, that it is desirable and in the public interest that said collateral facilities be relinquished to the City of Redlands for use as city streets; NOW, THEREFORE, IT IS VOTED by the California Transpor- tation Commission that it relinquish, and it does hereby relin- quish, to the City of Redlands, effective upon the recordation of a certified copy hereof with the Recorder of San Bernardino County, all of the State of California's right, title and interest in and to said collateral facilities in said City, together with the right of way and appurtenances thereof, described as follows: That portion of highway right of way, road 8-SBd-30, shown as Segments 1 through 3 to be relinquished as indicated on one set of three maps filed for record on April 15, 1988 in State Highway Map Book No. 13, pages 91, 92 and 93, in the office of the San Bernardino County Recorder.
