MEMORANDUM O1= AGREEMENT MODIFYING AMENDED LEASE
This Agreement is made September 21, 1971 by and between the City
of Redlands, herein designated as "Lessor" and TRI-CITY CONCRETE,
herein designated as "Lessee".
1. Parties hereto are the present Lessor and Lessee respectively
In that certain Amended Lease dated July 19, 1966, and under the terms
of said Amended Lease have negotiated and agreed to the rate of rental
and for the modification of lease terms as set forth herein.
2. It is agreed that the term of said lease shall be changed
from its present close of August 31, 1981 to June 30, 1981,
3. It is agreed that the five year rental periods set forth on
page 7 of the Amended Lease shall be changed from August 18, 1971 to
August 17, 1976 and August 18, 1976 to August 31, 1981, respectively
to July 1, 1971 to June 30, 1976, and July 1, 1976 to June 30, 1981.
4. It is agreed that the option granted the Lessee to renew
said lease for a further period of ten years shall also be changed
to conform to the aforesaid modified and extended rental period and
that the rate of rental to be paid for the period as extended shall
be for the periods respect i ;;ally :,f July 1, ifs i tihrccugh June 30,
1986 and July 1, 1986 through ;-ne- 30, :991.
5. The rate of rental to be pain by Lessee to Lessor for the
period of July 1, 1971 to June 30, 1976 shall be 3 cents per ton
for each and every ton of rock, gravel and sand and 0.6 cents for
each and every ton of subbase, fill or borrow,
IN WITNESS WHEREOF we have hereunto subscribed our signatures
